An application for extension of the term of use of a trademark may be filed within the prescribed time limit.
Article 40 of the Trademark Law stipulates that if the registered trademark needs to continue to be used after the expiration of its validity, the trademark registrant shall go through the renewal procedures in accordance with the provisions within 12 months before the expiration; In case of failure to handle the matter during this period, a six-month grace period may be granted. The term of validity of each renewal of registration is ten years, counting from the next day after the expiration of the last term of validity of the trademark. If no renewal formalities are gone through at the expiration of the time limit, the registered trademark shall be cancelled.
