When the relationship between the husband and wife breaks down and they can not reach consensus on divorce, they can only file a lawsuit for divorce to the court. When suing for divorce, in addition to paying the necessary acceptance fees, the final litigation fees will be determined according to the amount of property for the division of divorce common property.
According to the regulations, when a party files a divorce lawsuit, it shall pay the case acceptance fee according to the regulations, and the litigation fee will consist of the following parts:
1. The case acceptance fee refers to the fee charged by the people's court to the parties when accepting the case. In divorce cases, the average price is 50 to 300 yuan.
Note that if a divorce lawsuit is filed to divide the common property, that is, if the total amount of property does not exceed 200000 yuan, no additional acceptance fee will be paid; For the part exceeding 200000 yuan, the case acceptance fee shall be paid at 0.5.
2. Other litigation expenses, that is, other expenses other than the case acceptance fees that the parties should pay in the litigation.
Other expenses mainly include the following
(1) Inspection fee, appraisal fee, announcement fee, translation fee (except for the national language and written language commonly used locally).
(2) Transportation expenses, accommodation expenses, living expenses and subsidies for work delay of witnesses, experts and interpreters who appear in court on the date decided by the people's court.
(3) Application fees and actual expenses for adopting litigation preservation measures.
(4) The actual expenses incurred in executing the judgment, ruling or mediation agreement.
(5) Other litigation expenses that the people's court believes should be borne by the parties.
Therefore, when suing for divorce to divide the common property, the total amount of the common property must be considered, and the final litigation costs must be determined according to the total amount of the property.
Article 118 of the Civil Procedure Law of the People's Republic of China stipulates that:
