The maintenance between husband and wife refers specifically to the obligation of mutual support and support between husband and wife.
According to the Marriage Law, couples have the obligation to support each other.
If a party fails to perform its maintenance obligations, the party in need of maintenance has the right to demand maintenance fees from the other party.
Both husband and wife have equal obligations and rights to support.
The party who has the ability to support must consciously fulfill this obligation, especially when the other party is sick and loses the ability to work.
If one party refuses to perform, the other party has the right to require the other party to pay maintenance fees through mediation or litigation procedures.
If a spouse who is old, sick or has no ability to live independently refuses to perform his/her maintenance obligations and the circumstances are serious, he/she shall be investigated for criminal responsibility in accordance with the relevant provisions of the Criminal Law.
