According to Article 27 of the General Principles of the Civil Law, parents are guardians of minor children.
If the parents of a minor have died or are unable to supervise, the following persons with the ability to supervise shall act as guardians in order:
(1) Grandparents;
(2) Brother and sister;
(3) Other individuals or organizations willing to act as guardians, provided that consent is obtained from the neighborhood committee, village committee or civil affairs department in the place where the minor resides.
Article 28 An adult with no or limited capacity for civil conduct shall act as guardian in the following order:
(1) Spouse;
(2) Parents and children;
(3) Other close relatives;
(4) Any other individual or organization willing to act as guardian shall, however, obtain the consent of the residents' committee, the villagers' committee or the civil affairs department in the place where the guardian resides.
