(1) The legacy maintenance agreement is a legal act of both parties, and can only be established on the basis of voluntary consensus between the legacy party and the maintenance party. Legacy is a unilateral legal act of the testator, which can take legal effect without the consent of others.
(2) The legacy maintenance agreement is paid and has conditions attached to each other. Legacy is the act of the property owner to bequeath his property to the state, collective or individual in the form of a will before his life. It is not conditional on the legatee fulfilling his maintenance obligations for him.
(3) The legacy maintenance agreement shall become legally effective from the date of establishment of the agreement, while the legacy shall become legally effective from the date of death of the legator.
Article 31 of the Inheritance Law: Citizens can sign legacy maintenance agreements with their dependents. In accordance with the agreement, the dependents shall bear the obligation to support the citizen alive and die, and enjoy the right to bequeath.
