I have obtained a lawyer's certificate and went to graduate school. Can I still be a lawyer in school? Those who have obtained a lawyer's certificate and later went to graduate school, can work as a lawyer with a lawyer's license during their school years, and who have obtained a legal professional qualification certificate but are unable to actually practice law during their school years, will retain their lawyer's qualifications. In China, the lawyer qualification is separated from the lawyer practice, and the lawyer practice certificate is different from the lawyer qualification certificate. After obtaining the legal professional qualification certificate and going through internship, the certificate issued by the judicial administration department may temporarily suspend the lawyer profession and retain his qualification. A lawyer's qualification certificate is a necessary prerequisite for obtaining a lawyer's practice certificate. However, if there is only a lawyer's qualification certificate but no lawyer's practice certificate, it is not allowed to engage in lawyer's practice activities. The lawyer's practice certificate shall be issued by the provincial judicial administrative organ after the applicant's qualification and other requirements are examined and passed through the legal procedure. To obtain a lawyer's practice license, the applicant should not only have the necessary knowledge to obtain the lawyer's qualification, but also have the ability to actually perform the lawyer's business. According to the relevant provisions of the Order of the Ministry of Justice of the People's Republic of China: Article 17 The judicial administration organ shall implement an annual filing system for certificate holders who have not yet engaged in legal profession. The certificate holder who has not yet engaged in the legal profession shall, within the first quarter of each year, present a copy of the legal profession qualification certificate to the local (municipal) judicial bureau for annual filing. The local (municipal) judicial bureau shall report the annual record to the provincial (district, city) judicial department (bureau). Article 18 The judicial administration organ shall implement a change filing system for certificate holders who have already engaged in legal profession. The certificate holder shall, within 30 days after the change of occupation, take the copy of the legal professional qualification certificate to the local (municipal) judicial bureau to handle the change filing. The local (municipal) judicial bureau shall report the professional change of the certificate holder to the provincial (district, city) judicial department (bureau). The legal professional qualification certificate is different from the lawyer's practice certificate, so no matter what kind of lawyer's practice certificate is applied for registration based on the legal professional qualification certificate, the lawyer's practice certificate is protected by the provisions of the Law of the People's Republic of China on Lawyers, and the lawyer's practice is not subject to geographical restrictions.
