If the motor vehicle driver who is liable for compensation is unable to make compensation for the time being, the unit to which the driver belongs or the owner of the motor vehicle shall pay in advance, "causing direct losses to public property or other people's property, bearing all or main responsibility for the accident, and unable to make compensation of more than 400000 yuan, The court may sentence the person responsible for the traffic accident crime to fixed-term imprisonment of less than three years or criminal detention causing direct loss of public property or other people's property, bear all or the main responsibility for the accident, and the amount of disability compensation is more than 800000 yuan, the court may sentence the person responsible for the traffic accident crime to fixed-term imprisonment of more than three years but less than seven years.
 Those who are unable to bear the civil liability for compensation and bear more than the main responsibility, if the amount of compensation is more than 300000, they will bear criminal responsibility and go to prison. If the responsible person drives a motor vehicle, the part of the liability limit of the motor vehicle compulsory traffic insurance is compensated by the insurance company, which is not included in the amount of inability to compensate. If the other party is unable to compensate for the death caused by the traffic accident, the injured party can apply to the court for enforcement. The application period is two years. If the court still fails to enforce after exhausting all enforcement measures, the court will suspend the enforcement. After the economic condition of the other party has improved, the injured party can apply to the court for enforcement.
 Article 2 of the Interpretation of the Supreme People's Court on Some Issues Concerning the Specific Application of Law in the Trial of Criminal Cases Involving Traffic Accidents
 Whoever causes a traffic accident under any of the following circumstances shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention:
 （1） One person died or more than three people were seriously injured, and all or the main responsibility for the accident was borne
 （2） More than three people died, and they are equally responsible for the accident
 （3） Causing direct losses to public property or other people's property, bearing all or the main responsibility for the accident, and being unable to make compensation of more than 300000 yuan.
 If a traffic accident causes more than one person to be seriously injured, bears all or the main responsibility for the accident, and has one of the following circumstances, he shall be convicted and punished as a traffic accident crime:
 （1） Driving motor vehicles after drinking or taking drugs
 （2） Driving motor vehicles without driving qualification
 （3） Driving a motor vehicle knowing that the safety device is incomplete or the safety parts fail
 （4） Driving a motor vehicle knowing that it has no license plate or has been scrapped
 （5） Seriously overloaded
 （6） Escaping from the scene of the accident in order to avoid legal investigation.
