1. Both men and women who divorce by agreement must have the legal status of husband and wife;
2. Both husband and wife are indeed willing to divorce;
3. Both parties must be persons with full civil capacity;
4. The problems of children and property have been properly handled.
According to Article 31 of the Marriage Law, if both men and women wish to divorce, divorce shall be granted. Both parties must apply for divorce at the marriage registration office.
