1、 The solutions for the debtor's long-term non payment of arrears are as follows:
1. Both parties negotiate repayment;
2. Those who meet the conditions may apply to the people's court for a payment order;
3. Take legal action to the court.
2、 The prosecution must meet the following conditions:
1. The plaintiff is a citizen, legal person or other organization that has a direct interest in the case;
2. There are definite defendants;
3. There are specific claims, facts and reasons;
4. It falls within the scope of civil litigation accepted by the people's court and under the jurisdiction of the people's court to which the lawsuit is filed.
3、 The limitation period for applying to the people's court for protection of civil rights is three years. If the law provides otherwise, such provisions shall prevail. The limitation period of action shall be counted from the date when the obligee knows or should know that his rights have been damaged and the obligor. If the law provides otherwise, such provisions shall prevail. However, if it has been more than 20 years since the date of damage to rights, the people's court shall not protect them. Under special circumstances, the people's court may decide to extend them on the application of the obligee.
[Legal Basis]
Article 221 of the Civil Procedure Law of the People's Republic of China states that a creditor may apply to the basic people's court with jurisdiction for a payment order if the following conditions are met when requesting payment of money or securities from the debtor:
(1) There is no other debt dispute between the creditor and the debtor;
(2) The payment order can be served on the debtor.
The application shall clearly state the amount of money or negotiable securities requested and the facts and evidence on which it is based.
