Both parties are still legal husband and wife until the parties sue for divorce and the court makes a judgment on both parties' divorce and the judgment takes effect. Then, since they are legal husband and wife, they have the right to live together. At the same time, according to Article 15 of the Marriage Law, both husband and wife have the freedom to participate in production, work, study and social activities, and one party may not restrict or interfere with the other party. Article 20 stipulates that husband and wife have the obligation to support each other. If a party fails to perform its maintenance obligations, the party in need of maintenance has the right to demand maintenance fees from the other party.
