    The law does not stipulate that the party at fault should share less or no property, but the party without fault can claim damages from the party at fault. Of course, the law does not prohibit or interfere with one party voluntarily giving up the share of the husband and wife's common property.

    Article 1091 of the Civil Code states that the faultless party shall have the right to claim damages if divorce is caused by any of the following circumstances:
