The time limit for the public security organ to detain the case for investigation after filing the case is 14 days. Under special circumstances, the time can be extended for one to four days. The time limit for the People's Procuratorate to review and approve the arrest is seven days. However, for the criminal suspects who have wandered, repeatedly committed crimes in groups, the time limit for submitting for examination and approval may be extended to 30 days as prescribed by law. The period of custody for investigation after the arrest of a criminal suspect shall not exceed two months. If the case is complicated and cannot be concluded at the expiration of the time limit, it may be extended for one month with the approval of the People's Procuratorate at the next higher level.
Legal basis
In Article 156 of the Criminal Procedure Law of the People's Republic of China, the period of custody for investigation after the arrest of a criminal suspect shall not exceed two months. If the case is complicated and cannot be concluded at the expiration of the time limit, it may be extended for one month with the approval of the People's Procuratorate at the next higher level.
