At the time of divorce, the couple failed to deal with their debts incurred during the duration of their relationship, or their debts incurred after divorce due to the disposal of their original property and the upbringing of their children formed their joint debts after divorce. Specific circumstances include:
 (1) At the time of divorce, the two parties failed to deal with the debts jointly incurred during the existence of the marriage relationship, and the creditors claimed their rights after divorce;
 (2) Although the divorce agreement of both husband and wife or the judgment, ruling or mediation statement of the people's court has dealt with the problem of the division of husband and wife's property, the creditor claims rights from both husband and wife on their joint debts after divorce;
 (3) After divorce, the expenses that must be paid for the division of the former husband and wife's common property, such as the jointly entrusted appraisal fee, appraisal fee, transfer fee and other property handling fees;
 (4) Article 158 of the opinion of the Supreme People's Court on several issues concerning the implementation of the General Principles of the Civil Law of the People's Republic of China (for trial implementation) for debts caused by minor children infringing upon the rights and interests of others due to raising children or exercising the right to custody of children stipulates: "After divorce, if a minor child infringes upon the rights and interests of others, the party living with the child shall bear civil liability; If it is really difficult to bear civil liability independently, the party not living with the child may be ordered to bear civil liability jointly. "
