 Article 1191 of the Civil Code of the People's Republic of China [Responsibilities of the Employer and the Labor Dispatching Unit and the Labor Accepting Unit] If the employees of the Employer cause damage to others due to the performance of their work tasks, the Employer shall bear the liability for tort. After assuming the liability for infringement, the employing unit may recover compensation from the staff members who have committed intentional or gross negligence.
 During the period of labor dispatch, if the dispatched workers cause damage to others due to the performance of their work tasks, the accepting unit shall bear the tort liability; If the labor dispatching unit is at fault, it shall bear corresponding responsibilities.
