    This shall be undertaken according to the responsibility identified in the responsibility identification letter of the traffic police. The proportion of primary and secondary responsibilities for traffic accidents, and the proportion of responsibilities of all parties involved in traffic accidents:
    (1) If the motor vehicle party is fully responsible for the traffic accident, it shall bear 100% of the compensation liability;
    (2) If the motor vehicle party is mainly responsible for the traffic accident, it shall bear 80% of the compensation liability;
    (3) If the motor vehicle party bears the same responsibility in the traffic accident, it shall bear 60% of the compensation liability;
    (4) If the motor vehicle party takes secondary responsibility in the traffic accident, it shall bear 40% of the compensation liability;
    (5) The motor vehicle party is not responsible for the traffic accident, and its share of responsibility shall not exceed 10%.

    Legal basis: Article 92 of the Regulations for the Implementation of the Road Traffic Safety Law of the People's Republic of China

    If a party escapes after a traffic accident, the party who escapes shall bear full responsibility. However, if there is evidence to prove that the other party is also at fault, the liability may be mitigated.
