You can divorce an active serviceman, and the consent of the serviceman is generally required. Article 33 of the Marriage Law stipulates that the spouse of an active serviceman who wants to divorce must obtain the consent of the serviceman, except that the serviceman has a major fault.

(2) Article 14 stipulates that when people's courts hear divorce cases involving one-off expenses such as demobilization fees and self employment fees that are distributed to soldiers separately, the number of years of marital relationship between husband and wife multiplied by the annual average value, and the amount of income is the joint property of husband and wife.
