The vehicle is detained due to the need to collect evidence after drunk driving, and can be retrieved within five days from the date when the inspection report and appraisal opinion are determined.

Article 39 of the Provisions on Road Traffic Accident Handling Procedures stipulates that the traffic management department of the public security organ may detain the vehicle involved in the accident and issue a certificate of administrative coercive measures for the need to collect evidence. The detained vehicle shall be kept properly.

The traffic control department of the public security organ shall, within five days from the date when the inspection report and the expert opinion are determined, notify the party concerned to collect the detained accident vehicle.

The expenses incurred due to detaining the vehicle shall be borne by the traffic management department of the public security organ that made the decision, but the traffic management department of the public security organ shall notify the party concerned to collect it. The parking expenses incurred by the party concerned who fails to collect it within the time limit shall be borne by the party concerned.

If the vehicle that is not collected after 30 days of notification to the party concerned is still not collected after three months of public announcement, the detained vehicle shall be disposed of according to law.

    Legal basis

Article 30 of the Provisions on the Procedures for Handling Illegal Acts in Road Traffic Safety: For the detained vehicles, the traffic management department of the public security organ shall return them in a timely manner according to law after the relevant certificates or procedures provided or reissued by the parties concerned have been verified. The time for verification by the traffic management department of the public security organ shall not exceed ten days; If the extension is necessary, it may be extended to 15 days with the approval of the person in charge of the traffic control department of the public security organ at or above the county level. The verification time is calculated from the date when the vehicle driver or owner or manager provides the legal origin certificate of the detained vehicle, completes the corresponding procedures, or accepts the handling. If the vehicle needs to be detained due to evidence collection in case of road traffic accidents, the time for detaining the vehicle shall be in accordance with the relevant provisions of the Regulations on Road Traffic Accident Handling Procedures.
