After receiving the subpoena and notice of response from the court, you should answer the lawsuit according to the time and address, otherwise it will be deemed that you have given up your rights, and the court will still make a default judgment. If the property company has faults and deficiencies in the process of providing property services, you can actively collect evidence to defend by taking advantage of the time of adducing evidence. In addition, the claim of the property company should belong to the creditor's right, and you can check whether it has exceeded the limitation of action.
The owner shall pay the property fee in accordance with the provisions of the property service contract. If the owner refuses to pay the property fee in arrears, the property service company can sue in the court for payment. After being sued, the owner shall settle the property fee at the property in time and pay the penalty (late fee) as agreed in the contract. Otherwise, the property can apply to the court for enforcement after winning the lawsuit. There are generally three claims of the property company as the plaintiff:
    1. Require the defendant to pay the property fee owed
    2. Require the defendant to pay late fees
    3. The defendant is required to pay legal fees.
The above plaintiffs' claims will fully support the plaintiffs' claims in the case of a court decision, but the case of unpaid property fees is a civil dispute after all, and can be mediated by the court. As long as the defendant agrees to pay the property fees owed immediately in court, the judge will do the plaintiff's work to let the plaintiff withdraw the claim. If the defendant has difficulty in living, The judge will prepare a mediation statement to pay the property fees owed by installments. If the defendant does not obey the mediation, the judge can only fully support the plaintiff's claims.
Article 7 of the Property Management Regulations
The owner shall perform the following obligations in property management activities:
    (1) Abide by the management regulations and the rules of procedure of the owners' assembly
    (2) Abide by the rules and regulations on the use of common parts and facilities of the property in the property management area, and the maintenance of public order and environmental sanitation
    (3) Implement the decisions of the owners' meeting and the decisions of the owners' committee authorized by the owners' meeting
    (4) Pay special maintenance funds according to relevant national regulations
    (5) Pay property service fees on time
    (6) Other obligations stipulated by laws and regulations.
