Social security can be stopped when you are pregnant. Generally, you need to stop working during pregnancy, and you can not pay social security during this period. However, you can still choose to continue to pay insurance and enjoy maternity insurance benefits.
If the employer has paid maternity insurance premiums, its employees shall enjoy maternity insurance benefits; Unemployed spouses of employees shall enjoy maternity medical expenses in accordance with national regulations. The required funds are paid from the maternity insurance fund.
Maternity insurance benefits include maternity medical expenses and maternity allowances.
According to the regulations, employees who have one of the following circumstances can enjoy maternity allowance in accordance with national regulations:
(1) Female employees enjoy maternity leave after childbirth;
(2) Enjoy family planning surgery leave;
(3) Other circumstances stipulated by laws and regulations.
The maternity allowance shall be calculated and paid according to the average monthly salary of the employees of the employer in the previous year.
Legal basis
Article 56 of the Full Text of the Social Insurance Law of the People's Republic of China, if an employee has any of the following circumstances, he or she may enjoy maternity allowance in accordance with national regulations:
(1) Female employees enjoy maternity leave after childbirth;
(2) Enjoy family planning surgery leave;
(3) Other circumstances stipulated by laws and regulations.
The maternity allowance shall be calculated and paid according to the average monthly salary of the employees of the employer in the previous year.
