I don't want to rent the house for half a year. We can negotiate a settlement. Both parties agree to check out the house but will pay a certain amount of liquidated damages.

If the rental contract signed is longer than the actual rent, both parties need to negotiate. But normally, when renting a house, they will pay a month's rent as a deposit. If they do not rent because of their own reasons, it is a breach of contract. The landlord will regard the rent as a breach of contract, and will not return it. Then both parties will negotiate to return the house.

However, if the tenant fails to pay the rent normally, the landlord has the right to recover the overdue rent through legal means. Therefore, when renting a house, you should rent according to your own situation. Don't sign a contract for too long at one time, or you may be compensated when you check out, increasing the cost of renting a house.

    Legal basis

Article 578 of the Civil Code of the People's Republic of China [Anticipatory liability for breach of contract] If one party expressly expresses or indicates by its own behavior that it will not perform its contractual obligations, the other party may request it to bear the liability for breach of contract before the expiration of the performance period.

Article 585 [Liquidated Damages] of the Civil Code of the People's Republic of China [Liquidated Damages] The parties may agree that when one party breaches the contract, it shall pay a certain amount of liquidated damages to the other party according to the circumstances of the breach, or they may agree on the calculation method of the amount of compensation for losses arising from the breach.
If the agreed liquidated damages are lower than the losses caused, the people's court or arbitration institution may increase them at the request of the parties; If the agreed liquidated damages are too high than the losses caused, the people's court or arbitration institution may, at the request of the parties, appropriately reduce them.
If the parties agree on liquidated damages for delay in performance, the defaulting party shall perform its obligations after paying the liquidated damages.
