Common evidences for divorce due to a third party:
First, the letter of guarantee written by the other party;
Second, children may be the most powerful evidence;
Third, photos, audio and video recordings;
Fourth, the correspondence, SMS, email and call records between the two parties.
Article 36 of the Marriage Law of the People's Republic of China states that the relationship between parents and children shall not be eliminated by the divorce of parents. After divorce, whether the children are directly raised by the father or the mother, they are still the children of both parents.
