The handling process of traffic accidents is as follows:

    1. The party concerned needs to report and handle the case in time, and the public security and traffic management department will file the case after receiving the report.

    2. After accepting the case, the public security and traffic management department shall immediately investigate the scene, collect evidence, and determine the responsibility of the parties in the traffic accident according to the causal relationship between the violations of the accident parties and the traffic accident, the size of the role, etc.

    3. For specific compensation, the traffic management department shall convene both parties to mediate, and both parties agree to reach an agreement. The accident mediation personnel shall prepare and issue a mediation statement for damages.

    4. If the mediation of both parties fails within the statutory time limit, the public security and traffic management department shall terminate the mediation and issue a mediation termination statement. Both parties may bring a civil action to the court.

    [Legal Basis]

Article 70 of the Road Traffic Safety Law states that in case of a traffic accident on the road, the vehicle driver shall stop the vehicle immediately to protect the scene; If personal injury or death is caused, the driver of the vehicle shall immediately rescue the injured and promptly report to the traffic police on duty or the traffic control department of the public security organ. If the scene is changed due to rescuing the injured, the location shall be indicated. Passengers, drivers of passing vehicles and pedestrians shall provide assistance. If a traffic accident occurs on the road, without causing personal injury or death, and the parties have no dispute about the facts and causes, they can immediately leave the scene, resume traffic, and negotiate on their own to deal with the matter of compensation for damages; If they do not leave the scene immediately, they shall promptly report to the traffic police on duty or the traffic management department of the public security organ. If a traffic accident occurs on the road, which only causes minor property losses, and the basic facts are clear, the parties shall first leave the scene and then negotiate for settlement.
