    Legal basis

    Article 46 of the Full Text of the Social Insurance Law of the People's Republic of China, the maximum period for receiving unemployment insurance benefits is 12 months if the accumulated contributions of the employer and the unemployed before unemployment have reached one year but less than five years; The maximum period of receiving unemployment insurance benefits is 18 months if the cumulative payment of contributions has reached five years but less than ten years; For those who have paid contributions for more than 10 years in total, the maximum period for receiving unemployment insurance benefits is 24 months. After re employment, if the employee is unemployed again, the payment time shall be recalculated. The period of receiving unemployment insurance benefits shall be combined with the period of unemployment insurance benefits that should have been received but not yet received for the previous unemployment, and the longest period shall not exceed 24 months.
