    If a teacher beats a student in violation of the Teacher Law, the school, other educational institution or educational administrative department shall give him administrative sanctions or dismiss him. If the corporal punishment causes serious injuries, it also violates the Public Security Administration Punishment Law and the Criminal Law, and is suspected of intentional injuries. According to Article 37 of the Teachers Law of the People's Republic of China, a teacher who has one of the following circumstances shall be given administrative sanctions or dismissed by his school, other educational institutions or educational administrative department. (1) Deliberately failing to complete educational and teaching tasks, causing losses to educational and teaching work; (2) Corporal punishment of students, which is not corrected after education; (3) Those who behave badly, insult students and have a bad influence. If a teacher falls under one of the circumstances listed in sub paragraphs (2) and (3) of the preceding paragraph and the circumstances are serious enough to constitute a crime, he shall be investigated for criminal responsibility according to law. Article 234 of the Criminal Law of the People's Republic of China Whoever intentionally harms another person shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance. Whoever commits the crime mentioned in the preceding paragraph and causes serious injury to another person shall be sentenced to fixed-term imprisonment of not less than three years but not more than 10 years; Whoever causes death or serious injury to another person by especially cruel means and causes serious disability shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death. Where this Law provides otherwise, such provisions shall prevail. Article 235 Whoever negligently injures another person and causes serious injury to the person shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention.
