Drink driving, resulting in the death of the co pilot. Is the person who drinks together responsible? A person who drinks together is not responsible for trying to dissuade him or her from driving while he or she is drunk. If he or she does not dissuade or connive at driving while he or she knows it is illegal, he or she is jointly and severally liable. Article 22 of the Road Traffic Safety Law stipulates that motor vehicle drivers shall abide by the provisions of road traffic safety laws and regulations, and drive safely and in a civilized manner in accordance with operating specifications. Those who drink, take psychotropic substances or narcotic drugs under state control, or suffer from diseases that hinder the safe driving of motor vehicles, or are too tired to drive safely, shall not drive motor vehicles. No one may force, instigate or connive a driver to drive a motor vehicle in violation of road traffic safety laws and regulations and the requirements for safe driving of motor vehicles. Paragraph 3 of Article 22 above, "No one shall force, instigate or connive the driver to drive a motor vehicle in violation of road traffic safety laws, regulations and motor vehicle safety driving requirements", including the situation that "the serious consequences of drinking driving can be predicted by the table mates, but they do not stop or even connive", indicating that people who eat and drink together are jointly and severally liable. The people who are jointly and severally liable here are mainly conniving at drunk driving, not forcing or instructing others to drink driving.
