If both men and women are willing, it does not constitute a crime, but it is illegal. Please note that this is under age.
There are two versions of illegal cohabitation:
1. Married but cohabiting with others
2. Live together with others when unmarried
In the Marriage Law,
Article 3, 32 and 46 contain statements on cohabitation
Marriage Law of the People's Republic of China:
Article 3 Arranging marriages, buying and selling marriages and other acts that interfere with the freedom of marriage are prohibited. It is forbidden to ask for property through marriage.
Bigamy is prohibited. Persons with spouses are prohibited from cohabiting with others. Domestic violence is prohibited. Abuse and abandonment among family members are prohibited.
In the Interpretation on Several Issues Concerning the Application of the Marriage Law of the People's Republic of China, adopted on December 24, there is such an interpretation:
Article 2 The situation of "a person with a spouse cohabiting with another person" as stipulated in Articles 3, 32 and 46 of the Marriage Law refers to the continuous and stable cohabitation of a person with a spouse and the opposite sex outside marriage, not in the name of husband and wife.
