First of all, it is not necessary to distinguish between emotional intelligence and serious injury if personal injury is caused by infringement on others. As long as personal injury is caused, it is necessary to compensate medical expenses, nursing expenses, transportation expenses, nutrition expenses, hospital board subsidies and other reasonable expenses for treatment and rehabilitation expenses, as well as the income reduced due to missed work. If it causes disability, it shall also compensate for the cost of auxiliary equipment and disability compensation; If death is caused, funeral expenses and death compensation shall also be compensated.
 Secondly, if neither the victim nor the perpetrator is at fault for the occurrence of the damage, the losses shall be shared by both parties in accordance with the law.
 Finally, after the damage occurs, the parties may negotiate the payment method of compensation expenses. If no agreement is reached through consultation, the compensation fee shall be paid in a lump sum; If it is really difficult to make a lump sum payment, it may be paid in installments, but the infringed party has the right to request the provision of corresponding guarantees.

 Article 1182 of the People's Republic of China states that if property losses are caused by infringing upon the personal rights and interests of others, compensation shall be made according to the losses suffered by the infringee or the interests obtained by the infringer; If it is difficult to determine the losses suffered by the infringee and the benefits obtained by the infringer as a result, and the infringee and the infringer do not agree on the amount of compensation, and bring a lawsuit to the people's court, the people's court shall determine the amount of compensation according to the actual situation.
