The disabled can be identified after the treatment of the injured, and the disability level shall be subject to the identification result. Personal injury compensation items include: medical expenses, inpatient board allowance and nursing expenses, lost time expenses, nutrition expenses, transportation expenses, disability compensation, mental damage compensation, disability auxiliary equipment expenses, living expenses of the dependants, rehabilitation expenses, nursing expenses, follow-up treatment expenses actually necessary for rehabilitation care and continuous treatment. The specific compensation depends on the injury. If the negotiation fails, you can sue the perpetrator and the insurance company for compensation.
 The judicial confirmation of the traffic accident compensation agreement is made under the auspices of the traffic police department, or the parties reach an agreement through negotiation. After the confirmation of the traffic police department, if the parties are worried about the other party's reneging or not performing the mediation agreement, the traffic police department can inform the parties to request the people's court to make judicial confirmation of the mediation agreement. The people's court will charge 50 yuan for the case requesting judicial confirmation of the traffic accident mediation agreement. If the person liable for compensation refuses to perform the traffic accident mediation agreement after judicial confirmation, the person entitled to compensation may directly apply to the enforcement tribunal of the people's court for compulsory execution.

 The traffic management department of the public security organ shall, in accordance with the on-site inspection, examination and investigation of the traffic accident and the relevant conclusions of inspection and appraisal, timely prepare a letter of identification of the traffic accident as evidence for handling the traffic accident. The letter of determination of traffic accidents shall state the basic facts of the traffic accidents, the causes of the traffic accidents and the responsibilities of the parties concerned, and shall be served on the parties concerned.
