If both the husband and wife are overseas Chinese and want to divorce in China, whether one party wants to divorce or both parties want to divorce voluntarily, they must apply to the people's court in the place of marriage registration for divorce procedures. If a party is unable to return to his country due to special circumstances, he may handle a power of attorney, entrust a domestic relative or friend or lawyer as his agent, and submit a written opinion to the people's court. The power of attorney and opinion must be notarized by the local notary office and authenticated by our embassies and consulates abroad. The above-mentioned power of attorney and opinion can also be directly notarized by our embassies and consulates abroad. If they have applied for marriage registration at our embassies and consulates abroad and there is no dispute between the two parties when applying for divorce, they can apply for divorce from our embassies and consulates abroad who originally handled marriage registration; In case of dispute between the two parties, they shall file a lawsuit with the people's court of the last place of residence or domicile before going abroad.
