How to pay the stamp tax on house leasing?
According to the relevant provisions of the Interim Regulations on Stamp Duty, property leasing contracts include contracts for leasing houses, ships, aircraft, motor vehicles, machinery, appliances, equipment, etc., which shall be labeled at one thousandth of the lease amount, or 1 yuan if the tax amount is less than 1 yuan.
According to the relevant provisions of the Notice of the Ministry of Finance and the State Administration of Taxation on the Tax Policies Related to Low rent Housing, Affordable Housing and Housing Leasing (CS [2008] No. 24), the lease contract signed by individuals to rent and rent housing is exempt from stamp tax.
It can be seen that both parties to a housing lease contract, whether the lessor or the lessee is an individual, are exempt from stamp duty. If it is an enterprise, whether it is a lessor or a lessee, it must have tax decals.
