Guidelines for Government Information Disclosure

In order to better provide government information disclosure services and further promote government affairs disclosure and administration according to law, in accordance with the Regulations of the People's Republic of China on Government Information Disclosure (hereinafter referred to as the Regulations) and the relevant provisions of the Qinghai Provincial Government, the Guidelines for Government Information Disclosure of Qinghai Provincial Bureau of Local Financial Supervision (hereinafter referred to as the Guidelines) are hereby prepared. Citizens, legal persons and other organizations that need access to government information disclosure services of the agency are recommended to read the Guide and apply according to the procedural requirements. The Guidelines will be updated and explained in a timely manner in case of any change in the disclosure of government information of the Agency.

1、 Principle and classification of publicity

The government information mentioned in this Guide refers to the information produced or obtained by this organ in the course of performing its duties and recorded and preserved in a certain form. In addition to the information that is not allowed to be disclosed according to laws and regulations such as state secrets and the Regulations, as well as the information that may affect the national and public interests before and after the specific administrative act is taken, this organ will follow the principles of fairness, fairness and convenience to the people, and disclose government information in a timely and accurate manner.

There are two types of government information disclosure by this organ: active disclosure and disclosure upon application. Active disclosure refers to the disclosure of government information actively made public by this organ in accordance with the requirements of the Regulations; Application for disclosure refers to government information that meets the requirements of the Regulations but does not fall within the scope of active disclosure. Citizens, legal persons and other organizations apply to this organ for disclosure according to the procedures.

2、 Active disclosure

(1) Scope of disclosure

The scope of information that the agency actively discloses to the public. Citizens, legal persons and other organizations may consult on their own portals.

(2) Public form

This organ actively discloses government information mainly through the following ways:

1. Portal website of Qinghai Local Financial Supervision Bureau (website: http://dfjrj.qinghai.gov.cn/ ); Qinghai Provincial People's Government Information Disclosure Network (website: http://xxgk.qh.gov.cn

2. Relevant news media.

Citizens, legal persons and other organizations may obtain the information voluntarily disclosed by their own organs through the above means.

(3) Disclosure time limit

Government information within the scope of active disclosure shall be disclosed according to law within 20 working days from the date of information formation or change. If laws and regulations provide otherwise for the period of government information disclosure, such provisions shall prevail.

3、 Open upon application

Citizens, legal persons and other organizations that need government information other than those disclosed voluntarily by their own organs may apply to their own organs for access according to procedures. When this organ provides information according to the application, it shall provide the information according to the actual state of mastering the information, without processing, statistics, research, analysis or other processing of the information.

(2) Apply

If an application for government information disclosure is filed with this organ, the Application Form for Government Information Disclosure of Qinghai Provincial Financial Work Office (see the annex, hereinafter referred to as the "Application Form") must be completed. The copy of the Application Form is valid and can be downloaded from the portal website of this organ.

In order to improve the efficiency of processing the application, the applicant should describe the required information as detailed and clear as possible; If possible, please provide the title, release time, document number of the information or other hints that help the authority to determine the information carrier.

Citizens, legal persons and other organizations may apply in the following ways:

1. Online application. The applicant can fill in the electronic version of the Application Form on the government information disclosure website of the agency and send it through the Internet after completing the form.

2. Written application. After filling in the Application Form, the applicant can submit a written application by fax or letter. If the application is submitted by letter, please indicate "Application for Government Information Disclosure" at the lower left corner of the envelope.

This organ does not directly accept applications submitted by telephone.

(3) Application processing

After receiving the application, this organ shall reply within 20 working days from the date of receiving the application; If the reply period needs to be extended, it can be extended for 20 working days after approval and the applicant shall be informed.

If the disclosure of government information in accordance with the application will damage the legitimate rights and interests of a third party, the administrative organ shall solicit the opinions of the third party in writing. The third party shall put forward opinions within 15 working days from the date of receiving the request for opinions. If the third party fails to make comments within the time limit, the administrative organ shall decide whether to make it public in accordance with the provisions of these Regulations. If the third party disagrees with the disclosure and has reasonable reasons, the administrative organ shall not disclose it. If the administrative organ believes that the non disclosure may have a significant impact on public interests, it may decide to make it public and inform the third party in writing of the content and reasons of the government information it has decided to make public.

This organ shall respond to the information applied for disclosure in the following forms:

1. The content of the application is not clear, and the applicant is informed to make changes and corrections;

2. If the information applied for public has been actively disclosed, inform the applicant of the way and way to obtain the government information; It belongs to partially disclosed government information, and can provide the information content that can be disclosed.

3. If the information applied for publication can be disclosed, provide the applicant with the government information, or inform the applicant of the way, way and time to obtain the government information;   

4. If the administrative organ decides not to disclose the information in accordance with the provisions of these Regulations, it shall inform the applicant not to disclose the information and explain the reasons;   

5. If there is no public information applied for after searching, inform the applicant that the government information does not exist;

6. If the information applied for disclosure is not the responsibility of this administrative organ, inform the applicant and explain the reasons; If it is possible to determine the administrative organ responsible for disclosing the government information, the applicant shall be informed of the name and contact information of the administrative organ;  

7. If the administrative organ has replied to the applicant's application for the disclosure of government information, and the applicant repeatedly applies for the disclosure of the same government information, it shall inform the applicant not to deal with it repeatedly;   

8. If the information applied for public belongs to the relevant laws and administrative regulations that have special provisions on its access, the applicant shall be informed to go through the procedures in accordance with the relevant laws and administrative regulations.

4、 Supervision and guarantee

Citizens, legal persons or other organizations may report to higher administrative organs, supervisory organs or government departments in charge of information disclosure if they believe that their own organs have not fulfilled the obligation of government information disclosure according to law.

Citizens, legal persons and other organizations may apply for administrative reconsideration or bring an administrative lawsuit according to law if they believe that their specific administrative act in the work of government information disclosure infringes on their legitimate rights and interests.
