According to Chinese laws and regulations and the inspection and quarantine requirements of the General Administration of Customs of the People's Republic of China and the Ministry of Fisheries of the Democratic Socialist Republic of Sri Lanka on Sri Lanka's wild aquatic products exported to China, Sri Lanka's wild aquatic products that meet the following requirements are allowed to import and export from now on:
1、 Inspection and quarantine basis
(1) The Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine, the Regulations for the Implementation of the Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine, the Law of the People's Republic of China on Import and Export Commodity Inspection, the Regulations for the Implementation of the Law of the People's Republic of China on Import and Export Commodity Inspection, the Food Safety Law of the People's Republic of China, and the Regulations for the Implementation of the Food Safety Law of the People's Republic of China;
(2) Measures of the People's Republic of China for the Safety Administration of Imported and Exported Food and Regulations of the People's Republic of China for the Registration of Overseas Manufacturers of Imported Food;
(3) Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Fisheries of the Democratic Socialist Republic of Sri Lanka on the Inspection and Quarantine and Veterinary Hygiene Requirements for Wild Aquatic Products Exported from Sri Lanka to China (hereinafter referred to as the Protocol).
2、 Scope of imported products
Wild aquatic animal products and their products for human consumption do not include the species, live aquatic animals and aquatic animal and plant propagation materials listed in the appendix to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) and the List of China's National Key Protected Wildlife (LSKPWA).
3、 Requirements of manufacturer
Production enterprises exporting wild aquatic products to China (including fishing vessels, processing vessels, transport vessels, processing enterprises and independent refrigerators) should be approved by the Sri Lankan authorities and subject to their effective supervision. The sanitary conditions of the production enterprises shall meet the requirements of the relevant veterinary and public health laws and regulations of China and Sri Lanka.
In accordance with the Food Safety Law of the People's Republic of China and the Regulations for the Implementation of the Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine, the Ministry of Fisheries of the Democratic Socialist Republic of Sri Lanka (hereinafter referred to as Sri Lanka) shall recommend the registration of a production enterprise exporting wild aquatic products to China to the General Administration of Customs of the People's Republic of China (hereinafter referred to as China). Without registration, it is not allowed to export to China.
4、 Requirements for imported products
Sri Lanka shall ensure that the wild aquatic products exported to China meet the following conditions:
(1) Legal fishing in domestic or international waters of Sri Lanka.
(2) Raw materials and products are not in the areas involved in the following problems:
1. The occurrence of aquatic animal epidemics listed in the Catalogue of Entry Animal Quarantine Epidemics of the People's Republic of China and required to be notified by the World Organization for Animal Health (WOAH) in Sri Lanka has caused or may cause infection of wild aquatic products exported to China;
2. Major food safety incidents in Sri Lanka have affected or may affect the wild aquatic products exported to China;
3. The Sri Lankan side has seriously violated the laws and regulations of China and Sri Lanka as well as the provisions of the Protocol on the wild aquatic products it has exported or plans to export to China;
4. Major public health events occur in the production enterprise, such as employees infected with major infectious diseases, which have polluted or may pollute the wild aquatic products exported to China and their packaging and transportation vehicles;
5. The fishing area is affected by pollutants, such as radioactive pollutants, which have polluted or may pollute the wild aquatic products exported to China.
(3) Not directly or indirectly use drugs or additives prohibited by both parties, and use drugs or additives restricted or allowed by both parties according to regulations; After inspection by the competent authority, no pathogenic microorganisms, toxic and harmful substances and foreign matters listed in the laws and regulations of China and Sri Lanka are found.
(4) All wild aquatic products exported to China have been inspected and quarantined by the competent authority, and are healthy, safe, and suitable for human consumption. No pathological indications of infectious and parasitic diseases have been found, and no aquatic animal epidemics listed in the List of Quarantine Epidemics of Entry Animals of the People's Republic of China and the World Organization for Animal Health (WOAH) have been found.
(5) The whole process of fishing, processing, packaging, storage, transportation, transit and export shall comply with the relevant health requirements and traceability requirements of both parties, as well as the safety and health requirements related to the cold chain.
5、 Certificate requirements
Each container of wild aquatic products exported from Sri Lanka to China shall be accompanied by at least one original health certificate, proving that the batch of products comply with the laws and regulations of China and Sri Lanka on veterinary and public health and the relevant provisions of the Protocol. Sri Lanka shall fill in the health certificate with the information of production enterprises involved in the whole process of fishing, processing, packaging, storage, transportation, transit and export, including the names and registration numbers of fishing vessels, processing vessels, transport vessels, processing plants and independent refrigerators, and shall not omit the information of production enterprises involved in any of the above links.
The certificate shall be printed in Chinese and English (English is a required language when filling in the certificate). The format and content of the certificate must be approved by both parties in advance. Sri Lanka shall timely provide the sample of health certificate, official seal and handwriting of the signing officer to China for filing. In case of any change, Sri Lanka shall file it with China at least one month before it takes effect.
6、 Packaging and identification requirements
Wild aquatic products imported from Sri Lanka to China should have outer packaging and separate inner packaging. The internal and external packaging shall be brand new materials conforming to international health standards to meet the requirements of preventing pollution from external factors.
The inner and outer packages shall be labeled in Chinese and English or Sinhalese, including: trade name and scientific name, specification, production date, shelf life, batch number, storage conditions, production method (wild fishing), name and registration number of the manufacturer, production area and address of the manufacturer (specifically to the state/province/city), and destination (marked as the People's Republic of China).
For the wild aquatic products exported to China in the form of pre packaging, the Chinese label of the pre packaging should meet the requirements for the label of imported pre packaged food in China.
7、 Other requirements
China Customs implements import inspection and quarantine on wild aquatic products imported from Sri Lanka to China.
Nonconforming products will be returned, destroyed or otherwise disposed of in accordance with Chinese laws and regulations. For the production enterprises with serious problems or repeated unqualified problems, China will take measures such as strengthening inspection and quarantine or suspending import.
