Announcement No. 176 of the General Administration of Customs in 2023 (Announcement on Quarantine and Hygienic Requirements for Imported Uruguayan Edible Aquatic Animals)

In accordance with the relevant laws and regulations of China and the provisions of the General Administration of Customs of the People's Republic of China and the Ministry of Animal Husbandry, Agriculture and Fisheries of the Eastern Republic of Uruguay on the quarantine and hygiene requirements for Uruguay's edible aquatic animals exported to China, Uruguay's edible aquatic animals that meet the following relevant requirements are allowed to be imported from now on.

1、 Inspection and quarantine basis

(1) Biosafety Law of the People's Republic of China;

(2) Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine and its implementing regulations;

(3) Food Safety Law of the People's Republic of China and its implementation regulations;

(4) Law of the People's Republic of China on Import and Export Commodity Inspection and its implementation regulations;

(5) Measures for the Supervision and Administration of the Inspection and Quarantine of Entry Aquatic Animals;

(6) Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Animal Husbandry, Agriculture and Fisheries of the Eastern Republic of Uruguay on the Quarantine and Hygiene Requirements for Uruguay's Edible Aquatic Animals Exported to China (hereinafter referred to as the Protocol).

2、 Scope of imported products

The edible aquatic animals mentioned in this announcement refer to the live aquatic animals such as fish, crustaceans, mollusks, etc., which originated in Uruguay and are exported to China for food. The production methods include wild fishing and artificial breeding. The specific species do not include the appendix to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), and China's List of National Key Protected Wild Animals And the list of species listed in the List of Specially Managed Alien Invasive Species, and the list of relevant species are published on the website of the General Administration of Customs.

3、 Requirements of manufacturer

Production enterprises (including breeding farms and transit packaging farms) exporting edible aquatic animals to the People's Republic of China shall meet the following conditions:

(1) Approved and effectively supervised by the Ministry of Animal Husbandry, Agriculture and Fisheries of the Eastern Republic of Uruguay (hereinafter referred to as the Ukrainian side), it is recommended to the General Administration of Customs of the People's Republic of China (hereinafter referred to as the Chinese side) and has obtained the registration qualification of the Chinese side. The list of registered manufacturing enterprises will be published on the website of the General Administration of Customs.

(2) The edible aquatic animals exported to China shall comply with the quarantine, safety and health requirements of the People's Republic of China and the Eastern Republic of Uruguay for edible aquatic animals.

(3) The production enterprise shall establish and implement a self inspection, self-control and traceability system for the safety and health of edible aquatic animals to ensure that the whole process of breeding, fishing, packaging, storage, transportation, transit and export meets the relevant health and traceability requirements of both parties.

4、 Requirements for imported products

(1) The edible aquatic animals exported to China for wild fishing shall be legally fished in Uruguay's domestic or international waters; Artificial aquaculture shall be conducted in Uruguay's domestic waters.

(2) The drugs prohibited by both parties were not used during the breeding, harvesting, temporary breeding, packaging and transportation of edible aquatic animals exported to China. Use drugs restricted or allowed by both parties according to regulations.

(3) Uzbekistan should carry out effective monitoring on animal epidemics, toxic and harmful substances and food borne microorganisms of edible aquatic animals exported to China, and the monitoring results should meet the requirements of China's safety and health standards.

5、 Packaging and labeling requirements

(1) The edible aquatic animals exported to China from different fishing areas or registered enterprises should be packaged separately, and different kinds of edible aquatic animals should be packaged separately.

(2) The packaging container shall be new or sterilized to meet the needs of animal survival and welfare.

(3) Packaging materials, water or ice and bedding materials shall meet the safety and health requirements, and shall not contain pathogenic microorganisms, toxic and harmful substances, or aquatic organisms that may damage the ecological environment of water bodies.

(4) The outer package shall be labeled in Chinese, including the name and scientific name of edible aquatic animals, the fishing area (only applicable to wild aquatic animals), the name and registration number of breeding farms/transit packaging farms and export enterprises, and the destination must be the People's Republic of China.

6、 Pre export inspection and quarantine and certificate requirements

(1) The edible aquatic animals were confirmed to be healthy by the official Ukrainian veterinarians before export, and no clinical symptoms of animal infectious diseases and parasitic diseases were found.

(2) Uzbekistan shall submit the sample of health certificate and the sample of the official seal of the certification authority to China in advance, and they will take effect after being confirmed by China. Each batch of edible aquatic animals exported to China must be accompanied by a health certificate issued by the competent department of Uzbekistan. The health certificate must be in one original and two copies, and the original must accompany the goods. The health certificate shall be printed in English or Chinese, and shall be invalid if written (except for the signature of the inspection officer) or altered.

The health certificate shall at least include the following contents:

1. Variety (scientific name and Latin name), packaging type, quantity and weight of edible aquatic animals;

2. The edible aquatic animals are farmed, and the information such as the name and approval number of the farm;

3. The edible aquatic animals are caught in wild, and the specific information of the fishing waters, the name and approval number of the packaging enterprise and other information;

4. Name and address of exporter and importer;

5. Time of departure, port and type and number of means of transport;

6. Declare that edible aquatic animals meet the relevant requirements specified in this Protocol;

7. Declare that it is suitable for human consumption;

8. The issuing time of the certificate, the signature or seal of the official veterinarian of Uzbekistan;

9. Official seal of the competent department of Uzbekistan.

7、 Entry inspection and quarantine requirements

(1) Quarantine approval.

The import of Uruguayan edible aquatic animals shall go through the quarantine approval formalities in advance and obtain the Entry Animal and Plant Quarantine License.

(2) Verification of certificate.

1. Check whether the Entry Animal and Plant Quarantine License is attached.

2. Check whether it is from a registered enterprise.

3. Check whether the health certificate is true and valid.

(3) Inspection of goods.

In accordance with the provisions of relevant laws, administrative regulations, rules, etc., and in combination with this requirement, the Chinese Customs implements inspection and quarantine on imported Uruguayan edible aquatic animals. Those passing the inspection and quarantine are allowed to enter the country.

(4) Handling of nonconformities.

1. If any nonconformity is found in the process of certificate verification and goods inspection, it shall be handled in accordance with the relevant laws and regulations of China.

2. In case of major safety and health problems, China will take measures to strengthen inspection and quarantine, suspend the export of relevant enterprises to China, and even suspend the export of Uruguayan related edible aquatic animals to China.

8、 Other requirements

When the following situations occur:

(1) Aquatic animal epidemics listed in the List of Quarantine Epidemics of Entry Animals of the People's Republic of China and those that must be reported as required by the World Organization for Animal Health (WOAH) occurred in Uruguay, causing or possibly infecting edible aquatic animals exported to China.

(2) Any major food safety incident in Uruguay has affected or may affect the edible aquatic animals exported to China.

(3) Uruguay's export of edible aquatic animals to China seriously violates Chinese laws and regulations and the provisions of the Protocol.

(4) Uruguay's production enterprises have major public health events, such as the occurrence of major infectious diseases that may affect the safety of edible aquatic animals or the introduction of pathogenic diseases into China through edible aquatic animals, packaging and transportation vehicles.

(5) Uruguay's aquatic animals fishing area is affected by pollutants, such as radioactive pollutants, which have polluted or may pollute aquatic animals exported to China.

Uzbekistan should immediately stop the export of all edible aquatic animals to China from the corresponding fishing areas, breeding farms, production enterprises, regions and even the whole country, recall the problematic products and products with potential risks, report to China, and provide detailed information such as incident investigation, disposal and next control measures. Only after the Chinese side confirms that the above risks have been eliminated or reduced to a controllable range can the edible aquatic animals be exported to China again.
