On May 20, with the consent of the People's Government of Shandong Province, the Safety Committee of the People's Government of Shandong Province formulated and issued the Measures of Shandong Province for the Investigation, Handling, Promotion, Investigation and Listing Supervision of Work Safety Accidents (hereinafter referred to as the Measures). The Measures is an important supporting document for Shandong Province to establish and improve the accident investigation and handling system.
It is reported that the formulation of the Measures is not only a specific measure to improve the relevant working mechanism of accident investigation and handling in Shandong Province, but also to comprehensively improve the level of accident investigation and handling in the province, strengthen post supervision measures, and force enterprises to implement the main responsibility for safe production with strict accident investigation, effectively curb major accidents To prevent and resolve major safety risks and promote the practical needs of the province's work safety situation to improve steadily.
In combination with the practice of accident promotion investigation in the whole province, the Measures innovatively stipulates five situations that can be promoted for investigation: first, accidents that may constitute delayed report, omission, false report and concealment; Second, accidents that are particularly complex or have a particularly serious social impact; Third, the same enterprise's death accident occurred again within two years; Fourth, fatal accidents occurred within one year after the enterprise was warned, notified or interviewed; Fifth, fatal accidents occurred during the period when the enterprise was listed to supervise the rectification of major potential safety hazards.
The Measures clearly stated that the system of order to raise the level of investigation is that according to the authority of the government for accident investigation, the superior orders the subordinate to raise the level of investigation of the accident. By strengthening and improving the level of investigation of the accident, it can effectively punish and deter the accident enterprises, increase the accountability of relevant responsible units and personnel, and better play the role of accident lesson warning.
It is worth mentioning that the Measures, in combination with the practice of listing for supervision of accidents throughout the province, innovatively set seven situations that can be listed for supervision: first, accidents that are highly concerned by public opinion or the public and have significant social impact; Second, the accident that the people's government at a lower level is ordered to investigate; Third, fatal accidents occurred in the fields of road transportation, agricultural machinery, power safety, production and business fires; Fourth, the accident that did not complete the investigation within the legal time limit and was seriously overdue; Fifthly, the accidents that occur in the production and business operation activities of the production and business operation entities, which may or may be suspected of having natural disasters, criminal cases, sudden diseases, and which delay or even refuse to be included in the statistics; Sixth, it was found in the dispatch notice that there were serious problems in the investigation, such as non-standard procedures, inaccurate characterization, and inadequate accountability; Seventh, the investigation report and the official reply need to be re investigated after the administrative review and correction or the administrative lawsuit is lost.
In addition, Article 9 of the Measures innovatively stipulates that if the investigation and handling of the following accidents constitute a major accident, the Safety Committee Office of the provincial government shall hang a board to supervise the handling or request the people's government at the same level to raise the level of investigation; If the accident constitutes an ordinary fatal accident, the Safety Committee Office of the municipal government divided into districts shall hang up a board to supervise or request the people's government at the same level to raise the level of investigation: first, accidents occurred in the field of industry, mining and commerce; Second, accidents involving the operation during the special rectification of dangerous operation safety; Third, accidents occurred at important festival nodes or during major activities.
