Article 21 The Chinese People's Political Consultative Conference shall have a National Committee and local committees.

Article 22 The National Committee of the Chinese People's Political Consultative Conference is composed of representatives of the Communist Party of China, all democratic parties, persons without party affiliation, people's organizations, ethnic minorities and all walks of life, representatives of compatriots in the Hong Kong Special Administrative Region, Macao Special Administrative Region, Taiwan compatriots and returned overseas Chinese, as well as specially invited persons.
The composition of the local committees of the Chinese People's Political Consultative Conference shall be decided according to the local conditions and with reference to the composition of the National Committee.
Article 23 Any party or organization that endorses the Articles of Association may participate in the National Committee of the Chinese People's Political Consultative Conference with the consent of the Standing Committee of the National Committee of the Chinese People's Political Consultative Conference through consultation. Participation in local committees shall be handled by local committees at all levels in accordance with the above provisions of this Article.
Article 24 All units and individuals participating in the National Committee or local committees of the Chinese People's Political Consultative Conference have the obligation to abide by and perform the Articles of Association.
Article 25 The local committees of the Chinese People's Political Consultative Conference have the obligation to abide by and perform the national resolutions of the National Committee, and the local committees at lower levels have the obligation to comply with the regional resolutions of the local committees at higher levels.
Article 26 Proposals of the plenary meetings of the National Committee and local committees of the Chinese People's Political Consultative Conference shall be adopted by more than half of all the members. The bills and proposals of the Standing Committee shall be adopted by more than half of all the members of the Standing Committee. All participating units and individuals have the obligation to abide by and perform the resolutions of the meeting. Article 27 All units and individuals participating in the National Committee and local committees of the Chinese People's Political Consultative Conference have the right to fully express their opinions, participate in the discussion of major national policies and major local affairs through their own meetings and organizations, and make suggestions and criticisms on the work of state organs and state functionaries, And the right to report and expose violations of discipline and law, and to participate in the investigation and inspection activities organized by relevant departments.
Article 28 All units and individuals participating in the National Committee and local committees of the Chinese People's Political Consultative Conference have the freedom to withdraw from their positions.
Article 29 If any unit or individual participating in the National Committee and the local committees of the Chinese People's Political Consultative Conference seriously violates the Constitution of the Chinese People's Political Consultative Conference or the resolutions of the plenary meeting and the standing committee, the Standing Committee of the National Committee or the standing committee of the local committees shall, depending on the circumstances, give a disciplinary warning, Or disqualify them from participating in the National Committee or local committees of the Chinese People's Political Consultative Conference.
If the unit or individual who is given a warning or whose qualification for participation is revoked refuses to accept it, it may request reconsideration.

Article 32 Members of the National Committee and local committees of the Chinese People's Political Consultative Conference shall actively perform their duties and earnestly exercise their rights in accordance with the Articles of Association.
Article 33 Members of the National Committee and local committees of the Chinese People's Political Consultative Conference have the right to vote, vote and stand for election at their own meetings; Have the right to put forward opinions, criticisms and suggestions on the work of the Association.
Article 34 Members of the National Committee and local committees of the Chinese People's Political Consultative Conference shall adhere to their duties for the country and the people, keep in close contact with the masses, understand and reflect their wishes and requirements, and participate in meetings and activities organized by this Association.
Article 35 Members of the National Committee and local committees of the Chinese People's Political Consultative Conference shall correctly handle the relationship between their professional activities and the performance of their duties, and shall not use their membership to seek the interests of individuals, small groups and specific stakeholders.
Article 36 The National Committee and local committees of the Chinese People's Political Consultative Conference shall strengthen the management of members' performance of their duties, establish a file of members' performance of their duties, and report the performance of their duties in an appropriate manner.
Article 37 Those who seriously damage the interests of the state and the people, are given organizational treatment, punishment or sentenced for serious violations of discipline and law, are under investigation for suspected violations of discipline and law, and cheat in identity shall not be nominated or continue to be nominated as members.
Article 38 If it is inappropriate to continue to serve as a member due to job changes or other reasons, I shall resign as a member. Those who violate social morality or act inconsistent with the status of members shall be interviewed or consulted in a timely manner, and those who do not correct after being reminded shall be ordered to resign.
Article 39 The Standing Committee of the National Committee of the Chinese People's Political Consultative Conference or the Standing Committee of the local committees shall deal with members who violate disciplines and laws in accordance with laws and relevant regulations. If a member of the Standing Committee violates discipline and laws, the Standing Committee may make a decision to deal with it in accordance with laws and relevant provisions. Article 40 The number of participating units, members, candidates and constituencies of the National Committee of each Chinese People's Political Consultative Conference shall be decided by the Standing Committee through consultation after deliberation and approval by the previous session of the Chairman's Meeting of the National Committee.
During the term of office of each National Committee, if it is necessary to increase or change the number of participating units, members and candidates, the Standing Committee shall make a decision through consultation after deliberation and approval by the current session of the President's Meeting.
Article 41 The term of office of the National Committee of the Chinese People's Political Consultative Conference is five years. In exceptional circumstances, the term of office may be extended by the Standing Committee with a majority of more than two-thirds of all its members.
Article 42 The National Committee of the Chinese People's Political Consultative Conference shall have a Chairman, several Vice Chairmen and a Secretary General.
Article 43 The plenary session of the National Committee of the Chinese People's Political Consultative Conference shall be held once a year. When the Standing Committee deems it necessary, it may convene the meeting temporarily.
Article 44 The plenary session of the National Committee of the Chinese People's Political Consultative Conference shall exercise the following functions and powers:
（1） Revise the Articles of Association of the Chinese People's Political Consultative Conference and supervise its implementation;
（2） To elect the chairman, vice chairmen, secretary-general and standing members of the National Committee, and to decide on the increase or change of the members of the Standing Committee;
（3） Negotiate and discuss national policies and important issues in economic construction, political construction, cultural construction, social construction and ecological civilization construction, and put forward suggestions and criticisms;
（4） To hear and consider the work reports, work reports on proposals and other reports of the Standing Committee;
（5） Discuss the major working principles and tasks of the Association and make resolutions.
Article 45 The National Committee of the Chinese People's Political Consultative Conference shall establish a standing committee to preside over its affairs.
The Standing Committee is composed of the Chairman, Vice Chairmen, Secretary General and Standing Committee members of the National Committee. Candidates for the Standing Committee are nominated through consultation by the parties, organizations, nationalities and people from all walks of life participating in the National Committee of the Chinese People's Political Consultative Conference and elected by the plenary session of the National Committee.
The Standing Committee shall hold at least two thematic political meetings every year.
Article 46 The Standing Committee of the National Committee of the Chinese People's Political Consultative Conference shall exercise the following functions and powers:
（1） Explain the Articles of Association of the Chinese People's Political Consultative Conference and supervise its implementation;
（2） To convene and preside over the plenary session of the National Committee of the Chinese People's Political Consultative Conference; Before the first plenary meeting of each session, a preparatory meeting attended by all members shall be convened to elect the presidium of the first plenary meeting, which shall preside over the first plenary meeting;
（3） To organize the implementation of the tasks stipulated in the Articles of Association of the Chinese People's Political Consultative Conference;
（4） To implement the resolutions of the plenary session of the National Committee;
（5） When the plenary session of the National Committee is not in session, it examines and approves important proposals submitted to the National People's Congress and its Standing Committee or the State Council;
（6） To decide on the members of the National Committee through consultation;
（7） Appoint or remove the Deputy Secretary General of the National Committee of the Chinese People's Political Consultative Conference on the proposal of the Secretary General;
（8） To decide on the establishment and changes of the working organs of the National Committee of the Chinese People's Political Consultative Conference, and appoint or remove its leading members.
Article 47 The Chairman of the National Committee of the Chinese People's Political Consultative Conference shall preside over the work of the Standing Committee. The Vice Chairman and the Secretary General assist the Chairman in his work.
The chairman, vice chairmen and secretary-general form a meeting of chairmen to handle the important daily work of the Standing Committee.
The Council of Chairmen is entrusted by the Standing Committee to preside over the preparatory meeting for the first plenary meeting of the next session.
Article 48 The National Committee of the Chinese People's Political Consultative Conference shall have a number of Deputy Secretaries General to assist the Secretary General in his work. Establish a general office to work under the leadership of the Secretary General.
Article 49 The National Committee of the Chinese People's Political Consultative Conference shall, according to the needs of its work, establish a number of special committees and other working bodies. The special committees work under the leadership of the Standing Committee and the Council of Chairmen and play a fundamental role.
Chapter V Local Committees
Article 50 Provinces, autonomous regions and municipalities directly under the Central Government shall have provincial, autonomous regional and municipal committees of the Chinese People's Political Consultative Conference; Autonomous prefectures, cities divided into districts, counties, autonomous counties, cities not divided into districts, and municipal districts, where conditions permit, may establish local committees of the Chinese People's Political Consultative Conference in those places.
Article 51 The number of participating units, members, candidates and constituencies of the local committees of the Chinese People's Political Consultative Conference in each session shall be decided by the standing committee through consultation after being deliberated and agreed at the meeting of the chairman of the previous local committee.
During the term of office of each local committee, if it is necessary to increase or change the number of participating units, members and candidates for decision, the standing committee shall make a decision through consultation after deliberation and approval by the chairman's meeting of the local committee.
Article 52 The term of office of the local committees of the Chinese People's Political Consultative Conference at all levels is five years.
Article 53 The local committees of the Chinese People's Political Consultative Conference at all levels shall have a chairman, several vice chairmen and a secretary-general.
Article 54 The plenary meetings of the local committees at all levels of the Chinese People's Political Consultative Conference shall be held at least once a year.
Article 55 The plenary meetings of the local committees of the Chinese People's Political Consultative Conference at all levels shall exercise the following functions and powers:
（1） To elect the chairman, vice chairmen, secretary-general and standing members of a local committee, and to decide on the increase or change of the members of the standing committee;
（2） To hear and consider the work reports, work reports on proposals and other reports of the Standing Committee;
（3） Discuss and adopt relevant resolutions;
（4） Participate in discussions on important issues of national and local affairs, and put forward suggestions and criticisms.
Article 56 The local committees of the Chinese People's Political Consultative Conference at various levels shall have standing committees to preside over its affairs.
The standing committee is composed of the chairman, vice chairmen, secretary-general and standing members of the local committees. The candidates for the standing committee are nominated through consultation by the parties, organizations, nationalities and people from all walks of life participating in the local committees and elected by the plenary meeting.
Article 57 The standing committees of the local committees of the Chinese People's Political Consultative Conference shall exercise the following functions and powers:
（1） Convene and preside over the plenary meetings of local committees; Before the first plenary meeting of each session, a preparatory meeting attended by all members shall be convened to elect the presidium of the first plenary meeting, which shall preside over the first plenary meeting;

（4） When the plenary session of the local committee is not in session, it deliberates and passes important proposals submitted to the local people's congress and its standing committee or people's government at the same level;
（5） To decide on the members of local committees through consultation;
（6） Appoint and remove the Deputy Secretaries General of the local committees on the proposal of the Secretary General;
（7） To decide on the establishment and changes of the working bodies of local committees, and appoint and remove their leading members.
Article 58 The chairmen of the local committees of the Chinese People's Political Consultative Conference at various levels shall preside over the work of the Standing Committee. The Vice Chairman and the Secretary General assist the Chairman in his work.
The chairman, vice chairmen and secretary-general form a meeting of chairmen to handle the important daily work of the Standing Committee.
The Council of Chairmen is entrusted by the Standing Committee to preside over the preparatory meeting for the first plenary meeting of the next session.
Article 59 The local committees of the Chinese People's Political Consultative Conference at various levels may, as required, appoint one or more deputy secretaries general to assist the Secretary General in his work.
Article 60 The local committees of provinces, autonomous regions and municipalities directly under the Central Government shall establish general offices, and the establishment of special committees and other working organs shall be decided by the standing committees in accordance with the actual local conditions and work needs.
The establishment of the working offices of the local committees of autonomous prefectures, cities divided into districts, counties, autonomous counties, cities not divided into districts, and municipal districts shall be decided by the standing committees in accordance with the actual local conditions and work needs.
Chapter VI Emblem
Article 61 The emblem of the Chinese People's Political Consultative Conference consists of a five pointed star, a cogwheel and ears of wheat, a four sided red flag and ribbons, a map of China and the Earth "1949" and "Chinese People's Political Consultative Conference".
Article 62 In the emblem of the Chinese People's Political Consultative Conference, a five pointed star indicates the leadership of the Communist Party of China; Gears and ears of wheat are based on the alliance of workers and peasants; The four sided red flag and ribbon represent the great unity and unity of all parties, organizations, nationalities and strata; The map of China and the earth represent the unity of the people of the whole country, including compatriots in Hong Kong Special Administrative Region, Macao Special Administrative Region, Taiwan and overseas Chinese; "1949" and "Chinese People's Political Consultative Conference" are respectively the birth time and name.
Article 63 All participating units and individuals of the Chinese People's Political Consultative Conference shall safeguard the dignity of the emblem. The emblem shall be made and used according to regulations.
