Notice on Printing and Distributing the Interim Measures for the Management of Industrial Transformation and Upgrading Funds

Finance departments (bureaus), industry and informatization competent departments of all provinces, autonomous regions, municipalities directly under the Central Government, and cities specifically designated in the state plan, Xinjiang Production and Construction Corps Finance Bureau, industry and informatization competent departments:

In order to support industrial transformation and upgrading, we have set up industrial transformation and upgrading funds on the basis of integrating special funds such as electronic information industry development fund and integrated circuit industry research and development fund. In order to standardize the management and use of funds for industrial transformation and upgrading and improve the efficiency of fund use, the Ministry of Finance and the Ministry of Industry and Information Technology have formulated the Interim Measures for the Management of Funds for Industrial Transformation and Upgrading, which are hereby printed and distributed for implementation.

Interim Measures for the Management of Industrial Transformation and Upgrading Funds  

general provisions

   Article 1 These Measures are formulated in accordance with the Budget Law of the People's Republic of China and relevant national laws and regulations in order to standardize the management and use of funds for industrial transformation and upgrading and improve the efficiency of fund use.

   Article 2 The funds for industrial transformation and upgrading referred to in these Measures refer to the funds arranged by the central finance to support the transformation of the industrial development mode and promote the optimization and upgrading of the industrial structure.

   Article 3 The funds for industrial transformation and upgrading are jointly managed by the Ministry of Industry and Information Technology and the Ministry of Finance according to the division of responsibilities.

Chapter II Principles of Use Arrangement

   Article 4 The use and arrangement of funds for industrial transformation and upgrading should adhere to the following principles:

(1) Make overall planning and coordination, concentrate financial resources and make breakthroughs in key areas. Through the consultation mechanism, strengthen the overall management of industrial transformation and upgrading funds, concentrate funds to support weak links, and link the use of industrial transformation and upgrading funds with other related funds to form a joint force.

(2) The basic role of the market is combined with government guidance. Respect the laws of market economy, mobilize the enthusiasm of the whole society and jointly promote industrial transformation and upgrading through system and mechanism innovation.

(3) Innovate the way of financial support. In view of the weak links and prominent problems existing in the industrial transformation and upgrading, and according to the characteristics of each link, innovate the support mode of financial funds, and give full play to the use efficiency of financial funds.

(4) "Scientific, open and fair", and accept social supervision.

Chapter III Scope of Support

   Article 5 The scope of financial support for industrial transformation and upgrading includes:

(1) Public service platform construction. Support the construction of public service platforms that comply with national macroeconomic policies, industrial policies and regional development policies, provide R&D design, inspection and detection, test verification and quality certification services, information services for industrial industries, fields or regions, and improve the comprehensive utilization of resources.

(2) Informatization and industrialization are deeply integrated. Support projects such as enterprise informatization integrated innovation, product informatization and service-oriented manufacturing, and informatization services for industrial services and industry management.

(3) Improve the quality of industrial products and strengthen the cultivation of independent brands. Support the construction of quality assurance and safety management system, tackling key common quality problems, building capacity for quality control and technical evaluation of industrial products, and cultivating independent brands of industrial enterprises.

(4) Independent innovation in the industrial field. Support the research and development, industrialization, and promotion and application of electronic information technology and products in the core fields of the electronic information industry, such as software and integrated circuit industries, as well as computers, communications, networks, digital audio-visual, test instruments and special equipment, and basic electronic products.

(5) Cultivation of intellectual property capacity of industrial enterprises. Support the cultivation of industrial enterprises' ability to create and use intellectual property, risk assessment and early warning of industrial intellectual property, and the construction of industrial intellectual property comprehensive data service platform.

(6) Support for traditional Chinese medicine. We will support the construction of standardized, large-scale, and industrialized production bases for traditional Chinese medicine, and the construction of technical service platforms for the production of traditional Chinese medicine, production information service platforms, and supply guarantee platforms.

(7) Construction of industry standard system. Support the formulation, revision and review of industrial and communication standards, the development of international standards, and the management of industrial standards.

(8) Construction of SME service system. Support various social service institutions to build a service system with platform type public service function for the development of SMEs.

(9) Other fields of industrial transformation and upgrading determined by the Ministry of Industry and Information Technology and the Ministry of Finance.

Chapter IV Fund Management and Project Application Review Procedures

   Article 6 For the task of industrial transformation and upgrading directly undertaken by the Ministry of Industry and Information Technology, the required funds shall be included in the budget of the Ministry of Industry and Information Technology and implemented in accordance with the department budget and relevant regulations.

   Article 7 The funds needed for industrial transformation and upgrading projects undertaken by local governments are arranged in the central local transfer payment budget. The provisions of Articles 9 to 13 of these Measures shall apply.

   Article 8 In the second half of each year, the Ministry of Industry and Information Technology and the Ministry of Finance will issue the guidelines for the application of the next year's projects of industrial transformation and upgrading funds.

   Article 9 The competent departments of industry and information technology at the provincial level (including cities specifically designated in the state plan) are responsible for reporting the projects that meet the requirements of the Measures and the project application guidelines to the Ministry of Industry and Information Technology.

   Article 10 The Ministry of Industry and Information Technology organized experts to review and demonstrate the application materials.

   Article 11 The Ministry of Industry and Information Technology puts forward suggestions on the arrangement of funds for industrial transformation and upgrading based on the expert review opinions, and submits them to the Ministry of Finance for approval.

   Article 12 The Ministry of Finance, according to the declaration of the Ministry of Industry and Information Technology, combined with the annual budget arrangement, approved the annual industrial transformation and upgrading fund allocation plan after "checking the table" with other relevant special funds.

   Article 13 After receiving the funds for industrial transformation and upgrading, the project unit shall conduct financial accounting treatment according to relevant national regulations and standardize the use of funds.

Chapter V Supervision and Inspection

   Article 14 The Ministry of Industry and Information Technology and the Ministry of Finance shall supervise and inspect the use of funds for industrial transformation and upgrading and the implementation of projects.

   Article 15 The funds for industrial transformation and upgrading must be earmarked for specific purposes. It is strictly prohibited to intercept, occupy and misappropriate them. For those who violate the provisions of these Measures, in addition to the full recovery of the funds for industrial transformation and upgrading, the relevant units and personnel shall be held accountable in accordance with the Regulations on the Punishment and Punishment of Financial Violations (Order No. 427 of the State Council) and other relevant laws and regulations.

   Article 16 The Ministry of Finance will deduct the funds for industrial transformation and upgrading from the project unit that practices fraud, defrauds or fraudulently obtains the funds for industrial transformation and upgrading, and the Ministry of Industry and Information Technology will order the relevant local departments to make rectification. At the same time, the project unit may not declare the funds for industrial transformation and upgrading within three years.

Chapter VI Supplementary Provisions

   Article 17 The Ministry of Finance and the Ministry of Industry and Information Technology are responsible for the interpretation of these Measures.

   Article 18 The Measures shall be implemented as of August 10, 2012.
