Measures for Promoting School Enterprise Cooperation in Vocational Schools

 

general provisions

 

Article 1 In order to promote, standardize and guarantee the cooperation between vocational schools and enterprises, give play to the important role of enterprises in the implementation of vocational education, promote the formation of a common education mechanism of integration of industry and education, cooperation between schools and enterprises, combination of work and learning, and integration of knowledge and practice, build a large contingent of knowledge-based, skilled and innovative workers, and improve the modern vocational education system, according to the Education Law These Measures are formulated in accordance with the Labor Law, the Vocational Education Law and other relevant laws and regulations.

Article 2 The school enterprise cooperation mentioned in these Measures refers to the cooperative activities carried out by vocational schools and enterprises through joint education, cooperative research, joint establishment of institutions, sharing of resources and other means.

Article 3 The school enterprise cooperation implements the cooperation mechanism of school enterprise leadership, government promotion, industry guidance, and school enterprise dual subject implementation. Relevant departments of the State Council and local people's governments at all levels should establish and improve the promotion and support policies, service platforms and guarantee mechanisms for school enterprise cooperation.

Article 4 To carry out school enterprise cooperation, we should adhere to the principle of educating people, implement the national education policy, and strive to cultivate high-quality workers and skilled personnel; Adhere to the law, abide by national laws and regulations and cooperation agreements, and protect the legitimate rights and interests of all parties to the cooperation; Adhere to equality and voluntariness, mobilize the enthusiasm of both schools and enterprises, and achieve common development.

Article 5 The education administrative department of the State Council shall be responsible for the comprehensive coordination and macro management of the cooperation between vocational schools and enterprises, and shall do a good job of the relevant work together with the relevant departments.

The education administrative departments of the local people's governments at or above the county level shall be responsible for the overall coordination, planning guidance, comprehensive management and service guarantee of school enterprise cooperation within their respective administrative areas; Work together with other relevant departments to do a good job in local school enterprise cooperation according to the Measures and the division of responsibilities determined by the local people's government.

The competent industry departments and industry organizations shall coordinate, guide and promote the cooperation between schools and enterprises in their respective industries.

 

Chapter II Forms of Cooperation

 

Article 6 Vocational schools should, in accordance with their own characteristics and the needs of talent cultivation, actively cooperate with qualified enterprises and actively provide enterprises with the required courses, teachers and other resources.

Enterprises shall fulfill the obligation of implementing vocational education according to law, participate in school enterprise cooperation by using capital, technology, knowledge, facilities, equipment, management and other elements, and promote human resources development.

Article 7 Vocational schools and enterprises can carry out the following cooperation in talent training, technological innovation, employment and entrepreneurship, social services, cultural inheritance, etc. in combination with the actual situation:

(1) According to the demand of the employment market, cooperate to set up specialties, research and develop professional standards, develop curriculum systems, teaching standards, textbooks, teaching aids, and carry out professional construction;

(2) Cooperate to develop talent training or staff training programs, so that staff can work part-time for each other, and provide mutual support for students' internship and training, teacher practice, students' employment and entrepreneurship, staff training, enterprise technology and product research and development, achievement transfer and transformation, etc;

(3) According to the needs of enterprises' jobs, we will carry out apprenticeship cooperation, jointly recruit students, and implement school enterprise dual ownership sports personnel according to the work study combination model;

(4) Cooperate in running schools in various forms, cooperate in creating and jointly managing teaching and research institutions, build internship and training bases, technology and product development centers, and institutions for student innovation and entrepreneurship, staff training, skill identification, etc;

(5) Job specifications and quality standards of cooperative R&D;

(6) Organize and carry out skills competition, pilot construction of enterprises integrating production and education, excellent corporate culture inheritance, social services and other activities;

(7) Other cooperation methods and contents not prohibited by laws and regulations.

Article 8 Vocational schools should formulate school enterprise cooperation plans, establish educational and teaching organization methods and management systems that are suitable for school enterprise cooperation, clarify relevant institutions and personnel, reform teaching contents, methods and methods, improve quality evaluation systems, and provide support and services for the development of human resources and technological upgrading of cooperative enterprises; Enhance the technology and product R&D capabilities of service enterprises, especially SMEs.

Article 9 When a vocational school cooperates with an enterprise, it shall sign a cooperation agreement through equal consultation. The cooperation agreement shall clearly specify the objectives, tasks, contents, forms, rights and obligations of cooperation and other necessary matters, and reasonably determine the time limit for the implementation of the agreement according to the content of cooperation. Where an enterprise accepts interns, the cooperation time limit shall not be less than three Years.

Article 10 Enterprises with conditions are encouraged to establish or participate in the establishment of vocational schools, and to set up positions for student internships, apprenticeship training, and teacher practice; Enterprises above designated size are encouraged to set up staff training and continuing education institutions in vocational schools. The learning achievements of enterprise staff training and continuing education may be mutually recognized and linked with vocational school education in accordance with relevant regulations and measures.

The situation of school enterprise cooperation carried out by enterprises shall be included in the corporate social responsibility report.

Article 11 The competent departments of vocational schools shall, together with relevant departments and trade organizations, encourage and support vocational schools to establish long-term and stable cooperative relationships with relevant enterprises by establishing vocational education groups.

A vocational education group shall, in the form of articles of association or multi-party agreements, agree on the ways, contents, rights and obligations of cooperation among group members.

Article 12 Vocational schools and enterprises should establish a process management and performance evaluation system for school enterprise cooperation, regularly summarize the results of cooperation, jointly solve problems in cooperation, constantly improve the level of cooperation, and expand cooperation areas.

 

Chapter III Promotion Measures

 

Article 13 Vocational schools and enterprises in the eastern region are encouraged to cooperate with vocational schools and enterprises in the central and western regions to promote the development of vocational education in poverty-stricken areas, ethnic minority areas and old revolutionary base areas.

Article 14 When formulating industrial development plans, industrial incentive policies and poverty alleviation plans, the relevant departments of the local people's governments should take the promotion of enterprises' participation in school enterprise cooperation and the training of technical and skilled personnel as important contents, and strengthen guidance, support and services.

Article 15 The education, human resources and social security departments shall, together with the relevant departments, establish an information service platform for the integration of industry and education, and guide and assist vocational schools to establish cooperative relations with relevant enterprises.

Industry competent departments and industry organizations should give full play to their role, organize and guide enterprises to propose school enterprise cooperation intentions or plans, participate in school enterprise cooperation performance evaluation, and provide corresponding support and services to promote school enterprise cooperation according to industry characteristics and development needs.

Encourage relevant departments, industries and enterprises to jointly build an interconnected information platform for school enterprise cooperation, and guide various social entities to participate in the development of the platform and realize information sharing.

Article 16 The education administrative department shall take the school enterprise cooperation as the basic indicator to measure the level of running a vocational school, and put forward corresponding requirements in terms of school establishment, professional examination and approval, enrollment plan, teaching evaluation, teacher allocation, project support, school evaluation, personnel assessment, etc; Support should be given to new majors set up in cooperation between schools and enterprises to meet the needs of the employment market; Vocational schools should be encouraged and supported to cooperate with enterprises in setting up majors , Develop professional standards, training programs, etc.

Article 17 Vocational schools should include representatives of enterprises with close and stable cooperative relationships in the board of directors (board of directors) to participate in the deliberation of major issues of the school.

Vocational schools should fully listen to the opinions of the cooperative enterprises when setting up specialties, formulating training programs, curriculum standards, etc.

Article 18 Vocational schools are encouraged to cooperate with enterprises to develop apprenticeship training. Schools carrying out apprenticeship training should listen to the opinions of enterprises in terms of enrollment majors, quotas, etc. Enterprises that have the ability and need to cultivate technical and skilled personnel can cooperate with vocational schools to set up apprenticeship positions, jointly recruit students, jointly determine training programs, and cultivate them by combining work with learning.

The education administrative department and the human resources and social security department should give preference and support in the enrollment plan arrangement, student status management and other aspects.

Article 19 The National Development and Reform Commission, the Ministry of Education, together with the Ministry of Human Resources and Social Security, the Ministry of Industry and Information Technology, the Ministry of Finance and other departments, shall establish a work coordination mechanism to encourage the people's government at the provincial level to carry out pilot projects for the construction of enterprises integrating industry and education, and to encourage enterprises that deeply participate in school enterprise cooperation, have good behavior, achieve remarkable results, and have greater influence, Give commendation and corresponding policy support in accordance with relevant national regulations. The industrial and information administration departments at all levels shall take the participation of enterprises in school enterprise cooperation as an important indicator for the selection of service-oriented manufacturing demonstration enterprises and other relevant demonstration enterprises.

Article 20 Encourage local governments to support school enterprise cooperation through cooperation between government and social capital, purchase of services and other forms. Encourage local governments to choose social capital in a competitive way, and build or support enterprises and schools to build public practice and training, innovation and entrepreneurship bases, research and development practice courses, teaching resources and other public service projects. Implement policies such as fiscal and tax land use in accordance with regulations, and actively support the development of vocational education and the participation of enterprises in running schools.

Encourage financial institutions to prudently manage credit according to laws and regulations, and provide relevant credit and financing support for school enterprise cooperation.

Article 21 The reasonable expenses actually incurred by the enterprise in connection with the income obtained from the student internships and the employee education expenses incurred by the enterprise shall be deducted when calculating the taxable income according to law.

Article 22 The local people's governments at or above the county level may, in accordance with regulations, give corresponding preferential policies to enterprises that have achieved remarkable results in school enterprise cooperation; Vocational schools should be encouraged to jointly build productive training bases with enterprises by means of leasing sites and equipment, and corresponding preferential policies should be given according to regulations.

Article 23 The education, human resources and social security departments of the people's governments at all levels shall take measures to promote the rational flow and effective allocation of talents in vocational schools and enterprises.

Vocational schools can arrange a certain proportion of the total number of teachers and staff or employ part-time teachers from the society and enterprises, such as business management personnel, professional and technical personnel, highly skilled personnel, etc., by means of floating posts.

Article 24 The operation and management personnel, professional and technical personnel, and highly skilled personnel in the school enterprise cooperative enterprises, who have the qualifications for corresponding positions in vocational schools, can serve as full-time and part-time teachers and enjoy relevant treatment after being recognized and employed by vocational schools. The educational and teaching achievements obtained by the above enterprise personnel in the school enterprise cooperation can be regarded as the corresponding technological or scientific research achievements, and will be rewarded according to the regulations.

Vocational schools should take participation in school enterprise cooperation as the content of teachers' performance assessment. Professional teachers with work experience in related enterprises or production and operation management should be given priority in terms of evaluation, employment, promotion of positions (professional titles), evaluation and commendation of excellence under the same conditions.

Article 25 With the consent of the school or enterprise in which they work, the teachers and administrators, business management and technical personnel of the vocational school who work part-time in the enterprise or vocational school according to the cooperation agreement may be paid according to the relevant provisions and the agreement between the two parties.

Vocational schools, teachers and students with intellectual property rights in technological development, product design and other achievements can be priced and invested in enterprises according to laws and regulations. Vocational schools and enterprises have the autonomy in the use, disposal and revenue management of patents and products jointly developed according to the agreement between the two parties.

Article 26 Where a vocational school and an enterprise reach a cooperation agreement on students' participation in post following internships, post replacement internships and apprenticeship training, a tripartite agreement between the school, the enterprise and the students shall be signed, and the responsibility of the school and the enterprise in safeguarding the legitimate rights and interests of students shall be clarified.

The enterprise shall, in accordance with the law and regulations, protect the basic labor rights and interests of the post replacement interns or apprentices, and pay the remuneration in full and on time in accordance with the relevant provisions. No unit or individual may withhold it.

Article 27 Promote the establishment of compulsory insurance system for student internships. Vocational schools and internship units shall, in accordance with relevant regulations, insure interns with internship liability insurance. Vocational schools and enterprises shall agree on the obligation and responsibility of insuring interns' liability insurance in the agreement, and improve the mechanism of protecting students' rights and interests and risk sharing.

 

Chapter IV Supervision and Inspection

 

Article 28 The education supervision committees of the people's governments at all levels shall be responsible for the special supervision of the vocational schools and the governments in implementing the responsibilities of school enterprise cooperation, and shall regularly issue supervision reports.

Article 29 The education, human resources and social security departments at all levels shall take the school enterprise cooperation as an important part of the evaluation of the school running performance and level of vocational schools and the assessment of work objectives.

The education administrative departments of the people's governments at all levels, together with relevant departments and industry organizations, strengthen the supervision and guidance of school enterprise cooperation among enterprises, promote the models and practices with obvious benefits, promote the construction of enterprise credit system, and do a good job in management and service.

Article 30 Vocational schools and enterprises shall not damage the legitimate rights and interests of students, teachers, enterprise employees, etc. in the process of cooperation; In case of violation of relevant laws and regulations, the relevant competent department shall order rectification, and investigate the responsibilities of relevant units and personnel according to law.

Article 31 Where a vocational school or enterprise defrauds or fraudulently obtains government funds, the relevant competent department shall order it to return the funds within a time limit, and investigate the responsibility of the unit and its main responsible person and direct responsible person according to law and regulations; If a crime is constituted, criminal responsibility shall be investigated according to law.

 

Chapter V Supplementary Provisions

 

Article 32 The term "vocational schools" as mentioned in these Measures refers to secondary vocational schools (including ordinary secondary vocational schools, adult secondary vocational schools, vocational high schools, technical schools) and higher vocational schools established according to law.

The term "enterprises" as mentioned in these Measures refers to all kinds of enterprises registered in the administrative departments for industry and commerce at all levels.

Article 33 The cooperation between colleges and enterprises at other levels and types of institutions of higher learning, and the cooperation between vocational schools and institutions, institutions, social organizations and other institutions can be implemented with reference to these Measures.
