Regulations on the Administration of International Verification of the Import and Export of precursor chemicals

(Promulgated by Decree No. 8 of the Ministry of Commerce and the Ministry of Public Security on September 7, 2006, and implemented 30 days after the date of promulgation)

Article 1 In order to prevent precursor chemicals from flowing into illegal channels and regulate the international verification of the import and export of precursor chemicals, these Provisions are formulated in accordance with the Regulations on the Administration of precursor chemicals.

Article 2 The import and export of precursor chemicals (hereinafter referred to as "verification chemicals") listed in the Annex to these Regulations, the Catalogue for the Administration of International Verification of precursor chemicals (hereinafter referred to as "the Catalogue"), shall be subject to the international verification management system.

According to the actual situation, the Ministry of Commerce and the Ministry of Public Security may adjust the Catalogue and issue it in the form of announcement.

Article 3 The Ministry of Commerce and the Ministry of Public Security are jointly responsible for the international verification and management of the import and export of precursor chemicals throughout the country.

Article 4 Operators of the import and export of precursor chemicals (hereinafter referred to as operators) shall apply for permission to import and export verification chemicals in accordance with the relevant provisions of the Provisions on the Administration of the Import and Export of precursor chemicals.

Article 5 If a business operator applies for the export of chemicals for verification, the Ministry of Commerce shall conduct the examination within 5 days from the date of receiving the relevant electronic data and paper materials. If the requirements are met, the electronic data shall be transferred to the Ministry of Public Security for international verification.

Article 6 The Ministry of Public Security shall review the electronic data transmitted by the Ministry of Commerce within 3 days from the date of receipt, and send the qualified export application to the competent department of the government of the importing country or region for verification, and request a reply within 10 days.

In the process of electronic data review, the Ministry of Commerce may provide relevant paper materials at the request of the Ministry of Public Security.

Article 7 The Ministry of Public Security shall notify the Ministry of Commerce of the export application confirmed and replied by the competent department of the government of the importing country or region within 3 days from the date of receiving the verification and confirmation reply.

If the competent department of the government of the importing country or region fails to reply within the time limit, the Ministry of Public Security may, according to the international practice, specific products and the situation of the importing country and region, analyze and put forward suggestions on whether to permit exports and notify the Ministry of Commerce in writing.

Article 8 To verify the export of chemical samples, if the quantity of chemical samples is less than 100g (including 100g), no international verification is required. The Ministry of Commerce shall handle the matter in accordance with the Provisions on the Administration of the Import and Export of precursor chemicals, and report the results to the Ministry of Public Security.

Article 9 If the operator imports precursor chemicals and the competent department of the government of the exporting country or region puts forward international verification requirements to me, the Ministry of Public Security shall, within 5 days from the date of receiving the verification requirements, transmit the relevant materials to the Ministry of Commerce for confirmation.

The Ministry of Commerce shall verify the authenticity, qualification of operators and the rationality of the use of imported precursor chemicals. If necessary, the Ministry of Commerce may entrust the provincial competent commerce department to check. The provincial competent commerce department shall report the verification results within 10 days from the date of receiving the verification entrusted by the Ministry of Commerce. The Ministry of Commerce shall timely feed back the verification results to the Ministry of Public Security.

If it is necessary to check the actual use and consumption of the precursor chemicals imported by the operators, the Ministry of Public Security may entrust local public security organs to check, and the local public security organs shall report the results of the check within 10 days from the date of receiving the commission of the Ministry of Public Security, and the Ministry of Public Security shall timely notify the Ministry of Commerce.

The Ministry of Public Security shall, after receiving the verification results from the Ministry of Commerce and local public security organs, promptly notify the competent government departments of the exporting countries or regions.

Article 10 The operators of chemicals to be verified shall strengthen their internal management, establish and improve the management files for the import and export of chemicals to be verified, keep them for at least two years for future reference, and designate special personnel to be responsible for the work related to the import and export of chemicals to be verified.

The verification of chemical operators shall actively cooperate with the Ministry of Commerce and the public security organ in the verification.

Article 11 If it is found that the verification chemicals to be imported and exported may flow into illegal use, the Ministry of Commerce may revoke the issued license.

Article 12 The Ministry of Commerce and the Ministry of Public Security may regularly or irregularly publish relevant international verification results and operator violations.

Article 13 The Ministry of Commerce shall give a warning to chemical operators who violate the provisions of Article 10 after verification, and impose a fine of less than 30000 yuan if the circumstances are serious; Those who violate the administration of public security shall be punished by the public security organ according to law. If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 14 The Measures shall come into force 30 days after the date of promulgation. At the same time, the Regulations on the Administration of International Verification of the Import and Export of precursor chemicals (WJMTDT [2002] No. 147) issued by the former Ministry of Foreign Trade and Economic Cooperation and the Ministry of Public Security shall be repealed.
