Chapter II Determination and Handling of Violations

Article 6 Any examinee who violates the principles of fairness and impartiality in the examination and commits one of the following acts in the course of the examination shall be deemed to have cheated in the examination:

（2） Plagiarizing or assisting others to plagiarize the answers to test questions or materials related to the contents of the examination;

Chapter III Procedures for Determining and Handling Violations

Article 28 The educational examination institutions and educational administrative departments that accept the application for reexamination shall examine the fact of violation and the basis for application as determined in the handling decision, and after accepting the application thirty Within days, a review decision shall be made in accordance with the following provisions:
（1） If the facts are clearly identified, the evidence is conclusive, the application basis is correct, the procedure is legal, and the content is appropriate, the decision shall be maintained;
（2） In any of the following circumstances, the disposal decision shall be revoked or changed:
one . The violation facts are not clearly identified and the evidence is insufficient;
two . The application basis is wrong;
three Violating the handling procedures stipulated in these Measures.
The educational examination institution that made the decision shall remedy the losses caused to the examinees due to the wrong handling decision.
Article 29 If the applicant is not satisfied with the review decision or the handling decision, he may apply for administrative reconsideration or bring an administrative lawsuit according to law.
Article 30 Educational examination institutions shall establish archives of the integrity of candidates for national educational examinations, record and retain relevant information about candidates who cheat in national educational examinations. Without legal procedures, any organization or individual shall not delete or change the information recorded in the integrity file of national education examination candidates.
The integrity files of candidates for the national education examination can be inquired by relevant social parties according to their applications, and they should provide relevant information to the enrollment agencies in a timely manner as a reference condition for enrollment.
Article 31 Provincial educational examination institutions shall timely summarize the handling of the examinees and examination staff who violate the regulations in their own regions, and report to the national educational examination institutions.
Chapter IV Supplementary Provisions
Article 32 The examination room referred to in these Measures refers to the enclosed space where the examination is conducted; The examination site refers to a specific place where several examination rooms are set up to carry out examination activities independently; The term "examination area" refers to a specific area set up by a provincial educational examination institution and composed of a number of examination sites for the implementation of national educational examinations.
Article 33 The handling of violations of the national examination for part-time study for master's degree, the self-study examination for higher education of the Chinese People's Liberation Army and other educational examinations at all levels and in all kinds may refer to these Measures.
Article 34 These Measures shall come into force as of the date of promulgation. The previous regulations on the handling of violations of national education examinations promulgated by the Ministry of Education shall be repealed at the same time.
