Administrative Measures for Identification and Verification of Hidden Geological Hazards in Jiangsu Province

 

Article 1 In order to strengthen the dynamic management of geological hazard potential points throughout the province and standardize the identification and verification of geological hazard potential points, in accordance with the Regulations on the Prevention and Control of Geological Disasters, the Decision of the State Council on Strengthening the Prevention and Control of Geological Disasters, the Regulations of Jiangsu Province on the Protection of Geological Environment, and the Administrative Measures for the Identification and Verification of Extra Large Sudden Geological Hazard Potential Points (for Trial Implementation), The Measures are formulated.

Article 2 The potential points of geological disasters mentioned in these Measures refer to the places or sections where geological disasters may occur according to the preliminary survey of surface geology, topography and influencing factors.

These Measures are applicable to the identification and verification management of potential geological hazard points within the administrative region of this province.

The identification, verification, upgrading and demotion of the hidden danger points of extra large sudden geological disasters shall be implemented in accordance with the Administrative Measures for the Identification and Verification of the Hidden Danger Points of Extra Large Sudden Geological Disasters (Trial).

Article 3 The identification and verification of potential geological hazard points shall follow the principle of "territorial management and hierarchical responsibility", and work shall be carried out according to the process of "declaration, investigation, demonstration, confirmation and information disclosure".

Article 4 The new hidden danger points shall be identified according to the following procedures.

(1) Declaration. The county (city, district) natural resources authorities shall organize the declaration of new hidden danger points in a timely manner.

(2) Survey. The county (city, district) natural resources authorities, together with the housing and urban and rural construction, transportation, water conservancy and other relevant departments, organize the investigation and verification of the new hidden danger points discovered in the regional geological hazard investigation and evaluation, dynamic troubleshooting of geological hazard hazards, and patrol work, as well as the proposed new hidden danger points reported by the relevant responsible subjects and the masses. The investigation and verification work shall be entrusted to a unit qualified for geological hazard assessment and treatment engineering survey and design, and a confirmation investigation report shall be issued.

The identified investigation report shall include: survey overview, basic characteristics of hidden danger points, threat objects, stability analysis, hazard assessment, cause analysis and development trend prediction, conclusions and suggestions.

(3) Demonstration. The investigation report on identification of hidden danger points shall be demonstrated by experts organized by the county (city, district) natural resources department, and submitted to the natural resources department of the city divided into districts for review and confirmation.

(4) Confirm. The natural resources department of the city divided into districts shall review and confirm the reported new hidden danger points, and report the results to the provincial natural resources department.

(5) Information disclosure. If it is confirmed to be included in the management of geological hazard points after review, the county (city, district) natural resources competent department shall timely update the relevant information into the provincial geological hazard prevention and control management system, carry out daily management, implement relevant prevention and control measures, and disclose it to the society in the form of billboards, warning boards, etc.

Article 5 Hidden danger points that meet one of the following conditions may be declared for verification:

(1) The buildings in the danger zone have been completely demolished and there are no other fixed threat objects;

(2) Disappearance or stabilization of hazard body due to change of geological environment conditions;

(3) The project management has been completed and passed the acceptance.

Article 6 Procedures for verification and cancellation of potential geological hazard points in line with items 1 and 2 of Article 5:

(1) Declaration. The county (city, district) natural resources authorities shall organize the verification and declaration of hidden danger points.

(2) Survey. The county (city, district) natural resources authorities, together with the housing and urban and rural construction, transportation, water conservancy and other relevant departments, shall organize the verification and investigation of hidden danger points in their own administrative regions. The verification investigation shall be carried out by a unit qualified for geological hazard assessment and treatment engineering survey and design, and a verification investigation report shall be issued, and the verification opinions shall be clarified.

The main contents of the verification investigation report shall include: application form for verification of hidden danger points, survey overview, current situation of hidden danger points, existing threat objects, analysis of verification reasons, hazard analysis, conclusions and suggestions on main preventive measures to be taken in the next step.

(3) Demonstration. The investigation report on verification and cancellation of hidden danger points shall be demonstrated by experts organized by the county (city, district) natural resources department, and submitted to the natural resources department of the city divided into districts for review and confirmation.

(4) Confirm. The natural resources department of the city divided into districts shall review and confirm the reported verification hidden danger points, and report the results to the provincial natural resources department.

(5) Information disclosure. After verification, the county (city, district) natural resources competent department shall disclose the verification and cancellation situation and the subsequent work of the hidden danger points to the public.

Article 7 The hidden danger points that meet the requirements of Item 3 of Article 5 can be written off after being accepted by the natural resources authorities of the cities divided into districts, counties (cities, districts) or other responsible units in accordance with the relevant provisions of the Regulations on the Prevention and Control of Geological Disasters. The following data shall be submitted for verification: application form for verification of hidden danger points, completion acceptance data of treatment project, final acceptance opinions and list of experts.

Article 8 Potential geological hazard points shall be dynamically managed through the provincial geological hazard prevention and control management system. The upgrading and demotion of hidden danger points shall be re verified according to the identification or verification management process of hidden danger points. After the identification and verification of hidden danger points are completed, the natural resources competent departments of the cities divided into districts or counties (cities, districts) shall upload relevant data to the provincial geological disaster prevention and control management system in a timely manner.

Article 9 The identification and verification of hidden danger points shall adopt the combination of on-site survey and indoor examination. In principle, the demonstration expert group should be composed of 3~5 experts from the relevant disciplines of the provincial natural resources expert database. The expert group must demonstrate in the principles of objectivity, impartiality and science, and be responsible for the identification of hidden dangers and the conclusion of verification and cancellation.

Article 10 The provincial department in charge of natural resources shall organize the supervision and inspection of the identification and verification of geological hazard potential points throughout the province, carry out the annual inspection of important geological hazard potential points, organize experts to conduct random inspection and review of the potential points included in the provincial geological hazard prevention and control management system, and be responsible for the management and maintenance of the provincial geological hazard prevention and control management system.

Article 11 If there is concealment, false report, unauthorized verification or other dereliction of duty in the process of the supervision and administration of the identification and verification of geological hazards, the directly responsible person in charge and other directly responsible persons shall be given corresponding administrative sanctions in accordance with the relevant provisions of the Regulations on the Prevention and Control of Geological Disasters.

Article 12 If a unit with the qualification of geological disaster assessment and control engineering survey and design has falsified its qualification, intentionally concealed the real situation of geological disasters or other illegal acts in the process of carrying out the identification and verification of geological disaster hidden danger points, the relevant responsible unit shall be fined in accordance with the relevant provisions of the Regulations on the Prevention and Control of Geological Disasters Penalties such as lowering qualification level or revoking qualification certificate.

Article 13 These Measures shall be interpreted by the Natural Resources Department of Jiangsu Province.

Article 14 These Measures shall come into force as of May 1, 2024 and shall be valid until May 1, 2029.
