According to Mr. Li, on the afternoon of November 12, he took his children to the Aegean Sea Trade Center in Cangshan District, Fuzhou for dance lessons. At about 4 p.m., when the children finished their lessons, they saw the sign of Burger King on their way to the parking place of electric bicycles. The children wanted to eat hamburgers, so they went into the store with them to buy a chicken leg burger.

After scanning the code and ordering the meal, Mr. Li waited in front of the dining table because he was ready to pack and take it away. Since the back kitchen was not far away from the dining table, he inadvertently scanned the back kitchen and found that a male employee not only did not wear a mask when making hamburgers for himself, but also kept talking to people around. After getting the hamburger, Mr. Li also observed for a few minutes, and found that the employee had never worn a mask when making food for other customers, and no colleagues around reminded him or asked him to wear a mask. "Burger King is also a well-known catering brand. I remember there was a regulation that catering staff should wear masks when working, but restaurants of such a famous brand did not comply with it. What else can people believe?"

After receiving the complaint from Mr. Li, in the evening of the same day, the reporter also came to the Hamburg Wang Aiqin Seafood Shop and ordered a meal as an ordinary consumer.

 

In the process of waiting, the reporter found that a male employee did not wear a mask from beginning to end and was making food in the kitchen. When he was free, he also took some raw materials and began frying. In this process, he really kept talking with people around him. There were several staff members in the store, but no one reminded him to wear a mask.

After seeing the photos taken by the reporter, she said that the store had just opened last month, and there was also training for employees, who were required to wear masks. However, it may be an oversight in management, which led to some employees' failure to cooperate. From now on, the employees in the store will wear masks to serve customers.

 

Later, the reporter called the official customer service hotline of Burger King, and the customer service staff confirmed that Burger King Aegean Seafood Store was an official direct store. He said that Burger King did not require employees to wear masks on duty.

However, in the afternoon of November 13, a person in charge of Burger King called the reporter, saying that after investigation, the phenomenon photographed by the reporter existed, and hereby made a solemn apology to the consumer. At present, the company has reiterated that all employees must wear masks to work.

Punish the involved stores and employees

 

In response to the practices of Burger King employees, lawyer Lin Shanzhi, a special lawyer of Rights Defense 007 and a partner of Fujian Yingrong Law Firm, said that on January 21, 2021, the Standing Committee of the 13th People's Congress of Fujian Province voted to adopt the Regulations of Fujian Province on Wearing Masks for Catering Service Employees. According to the Regulations Catering service employees who are in direct contact with imported food work, such as passing vegetables, should wear clean masks in a standardized manner when working, and it has become a legal obligation for catering service employees to wear masks. In addition, according to Article 33 of the Food Safety Law, food operators should maintain personal hygiene. When selling food, they should wash their hands and wear clean work clothes and hats. "This' wait 'should include masks. According to the photos taken by the reporter, Burger King food producers did not wear masks, which has been suspected of breaking the law."

Lawyer Lin said that if diners found that employees did not wear masks, they could ask them to correct, or report to the market supervision and administration department and provide evidence. The Provisions of Fujian Province on Wearing Masks for Catering Service Employees also clearly stipulates that if employees do not wear masks as required, the competent department shall order them to correct. If they refuse to correct, they shall be fined 50 yuan for individual businesses and 200 yuan to 1000 yuan for other catering business entities.

"The statement made by the staff of Burger King's national hotline has no factual and legal basis. According to the provisions of Article 70 of the new Regulations on the Implementation of the Food Safety Law, if the food production and operation behavior does not comply with the provisions of Article 33 of the Food Safety Law, the competent department may order the food and beverage stores involved to make corrections and give a warning; if they refuse to make corrections, they may be fined." Lawyer Lin said that in the face of such clear evidence, the relevant competent authorities of Cangshan District should take the initiative to intervene and deal with the matter.

In the eyes of many people, what happened to Mr. Li may be a very small thing - isn't it that the restaurant staff didn't wear masks when making food? As long as the food itself is safe, even if the employees do not wear masks, there will be no problem.
