National Health Commission: medical institutions that carry out human organ acquisition and transplantation should set up an ethics committee

According to the website of the National Health Commission, in order to guarantee human life and health, safeguard human dignity, respect and protect the legitimate rights and interests of human organ donors and transplant recipients, and standardize the ethical review of human organ transplantation ethics committees in medical institutions, according to the Civil Code of the People's Republic of China and the Law of the People's Republic of China on Basic Medical Hygiene and Health Promotion The National Health Commission has formulated the Rules of Procedure of Human Organ Transplantation Ethics Committee (hereinafter referred to as the Rules of Procedure) and other laws and regulations such as the Regulations on Human Organ Donation and Transplantation.

The Rules are applicable to the ethical review of human organ donation and transplantation carried out by the Human Organ Transplantation Ethics Committee of medical institutions in accordance with the law, including the ethical review of the acquisition of remains and organs, and the ethical review of the acquisition of living organs.

The Rules of Work clearly stipulates that in the process of human organ donation, acquisition and transplantation, the basic ethical principles of being beneficial, harmless, respecting life, fairness and justice, conforming to laws and public order and good customs should be followed.

According to the Work Rules, medical institutions that carry out human organ acquisition and transplantation shall set up an ethical committee for human organ transplantation, and the medical institution shall be responsible for the management of the ethical review of human organ transplantation in its own unit. The Rules of Work clearly stipulates the professional coverage, number of members, duration, conditions and voting rights of the members of the Human Organ Transplantation Ethics Committee.

The Ethics Committee of Human Organ Transplantation shall examine the following matters after receiving the application for examination of obtaining organs from remains:

(1) Whether the written willingness to voluntarily donate remains and organs for free is true;

(2) Whether the informed consent related to organ donation of remains complies with the provisions of laws and regulations;

(3) Whether there is any sale or disguised sale of remains and organs and the referral of potential donors of remains and organs across service areas;

(4) The medical evaluation of the donor and the organ donor;

(5) Compliance with medical and ethical principles.

After receiving the application for examination of obtaining living organs, the Ethics Committee of Human Organ Transplantation shall examine the following matters:

(1) Whether the willingness to donate living organs is true;

(2) Whether there are situations of buying and selling living organs or buying and selling in disguised form;

(3) Whether the recipient of living organs is the donor's spouse, direct blood relatives or collateral blood relatives within three generations, and check the authenticity of the relevant certification materials specified in Article 13;

(4) Whether the matching of living organs and the indications of transplant recipients conform to the relevant technical specifications of clinical application of human organ transplantation technology;

(5) Whether the health and psychological status of the living organ donor are suitable for organ donation;

(6) Compliance with medical and ethical principles.

The Rules of Work clearly stated that after receiving the application, the Human Organ Transplantation Ethics Committee should hold a review meeting in a timely manner and issue opinions based on the discussion results. In case of emergency, on the premise of ensuring information security, the meeting can be held by video or other means and records can be kept. Written opinions on the acquisition of remains or living organs can only be issued with the consent of more than two-thirds of the members of the Ethics Committee for Human Organ Transplantation.

In order to ensure that the Human Organ Transplantation Ethics Committee performs its duties according to law, the Rules of Work clearly stipulates that medical institutions should bear the main responsibility for the ethical review of human organ transplantation; The health administrative departments at or above the county level shall be responsible for the supervision and administration of the ethical review work; The provincial health administrative department shall guide relevant medical institutions to set up an ethics committee for human organ transplantation, strengthen supervision and standardize ethical review.
