There are ups and downs in property selection

A few days ago, the reporter from Southeast Network came to the Sunrise Oriental Community located at Yuanyang Road, Fuzhou City twice. There are piles of garbage in the community, fire hydrants are exposed, and the badminton court has become a clothes drying yard

Huang Youhao, deputy director of the community industry committee, told reporters that there were 1254 households and more than 5000 owners in Fuzhou Sunrise Oriental Community. In 2005, it was rated as the national excellent model community. In recent years, due to the poor management of the property company, the community health, safety and other issues frequently occur. In September 2017, the property service contract expired, and the community started the process to re select the property company. Under the supervision of the neighborhood committee and the vote of the owners' meeting, the newly elected Shenzhen Kaiyuan International Property Management Co., Ltd. signed a service contract with the community industry committee on November 25 last year.

However, the original property was delayed in handover and withdrawal, and the new property was difficult to enter the site. The management of the community was chaotic, and hundreds of owners once gathered to drive away the original property company. After two coordination meetings convened by the District Political and Legal Committee, District Housing Management Bureau, Gushan Town Government, Gushan Police Station and other relevant departments, in December 2017, the original property finally withdrew and Kaiyuan Property settled in Sunrise Oriental Community.

According to the procedure, the new property company needs to go through the property filing procedures at the property department of the local housing management bureau. However, the property department of Jin'an District Housing Management Bureau said that some owners complained that the property replacement in the community was not standardized and needed further investigation, so they refused to accept the filing materials. Five months later, the filing formalities have not been completed yet. It is inconvenient for Kaiyuan Property to carry out its work. It is difficult to change the appearance of the community for a while.

"As a listed enterprise, we were initially unwilling to collect property fees from residents before the completion of the filing, and paid various expenses of more than 800000 yuan in advance three months after entering the site," the person in charge of Kaiyuan Property told reporters.

Owners vote in property elections.

The owner's complaints become "obstacles" for filing

In the property department of Jin'an District Housing Management Bureau, the reporter saw the complaint letter of Sunrise Oriental owner. It is alleged in the letter that the owners' meeting has never been held for the removal and replacement of properties in the community, the owners' opinions have never been consulted and voted, and the selection process is suspected of being operated in a dark box... At the end of the letter, there are signatures and fingerprints of several owners in the community.

Chen Xuerong, the head of the property section of Jin'an District Housing Management Bureau, said that according to the normal procedure, as long as the filing materials are complete and the election results are "more than half" (more than half of the households who voted in favor and occupied more than half of the building area), the filing can be completed in only one week. However, because some owners complained that the selection process was not open and fair enough, the Housing Authority could not confirm it, so the local government should provide a written explanation and seal. "The year before last, there was a fierce contradiction in this community because of the change of the industry committee. Some industry committees complained for a long time, so we must be cautious this time."

As a key link, the government of Gushan Town refused to provide proof: "The Housing Authority can transfer the complaints of the owners to Gushan Town, and the town will directly give feedback, which has nothing to do with the record." Lin Xiaodong, the head of the property station of Gushan Town, believes that the Sunrise Oriental neighborhood committee has participated in the property selection process and sealed the election results, which represents that the town government has recognized the fairness and legality of the election, It is unnecessary and groundless to prove again.

In order to understand the election details, the reporter visited several owners in Sunrise Oriental Community. Some people said they didn't know about it, some people said they voted, and some people knew about it but didn't participate. At Sunrise Oriental Neighborhood Committee, Ms. Chen, a staff member, showed reporters a large number of photos during the election process and said that the Neighborhood Committee had supervised and participated in the property re-election throughout the process, and the operation was very rigorous.

Functional departments also need to restrict

Property re-election disputes are common, especially the handover of new and old properties. In this regard, Huang Anyong, director of the Property Management Research Institute of Southeast University, once analyzed to the media that one of the reasons was that the selection procedure of the property company was not standardized, and the opinions of many community industry committees only represented some owners, which led to different opinions when selecting the property company.

Huang Anyong suggested that the industry committee could hire property management experts and professional legal advisers to provide professional advice on the industry committee's filing, bidding and takeover procedures of new and old properties, so as to make the handover more smooth.

Gan Mantang, a member of the expert committee on urban and rural community governance in Fujian Province and a professor of sociology at Fuzhou University, has a slightly different view. He believes that community management is difficult to adjust, and can only be handled according to the principle that the minority is subordinate to the majority; In communities with industry committees, industry committees represent most owners.

Gan Mantang pointed out that many owners are not enthusiastic about community management, and it is not easy to have more than half of the election results; The industry committee shall exercise rights on behalf of most owners, and functional departments shall give guidance, support and cooperation. If the procedures are complete and legal, the functional departments should deal with them within a time limit to improve the efficiency; In case of shirking responsibility or excuse for delay, the superior department shall be held accountable. "If the functional department of the community is blocked from going through the normal procedures, it can apply for the intervention of the efficiency office, complain to the superior discipline inspection commission, or ask the news media to expose it." Gan Mantang suggested.

Lin Changqing, vice president of Fujian Property Management Association and representative of Fujian Provincial People's Congress, also pointed out that the behavior of functional departments needs to be restricted. In case of administrative inaction and disorderly behavior, there should be an effective third-party coordination mechanism, so that every subject is under supervision and restriction, and the phenomenon of lawlessness should be eradicated.

From the perspective of resolving internal conflicts, Li Chunfang, a social worker of Lin Wenjing Charity Foundation, appeals to the public to actively participate in the public affairs of the community, fully understand the information, and rationally treat community conflicts, so as to prevent one-sided information and irrational emotions from bringing things to an extreme situation.
