Self discipline Convention on Internet Audiovisual Program Services in China
In order to promote the long-term development of the Internet audio-visual program service industry, create a healthy and orderly Internet audio-visual program service environment, and safeguard national and public interests, the contracting parties to this Convention hereby make the following self-discipline conventions:
1、 All contracting parties shall fully realize that pornographic, violent and vulgar audio-visual programs and infringing and pirated audio-visual programs are spread wantonly on the Internet, which has seriously polluted the network environment, affected the healthy growth of minors, and damaged the long-term development of the Internet audio-visual program service industry. China's Internet audiovisual program service units, including contracting parties, should take corresponding social and media responsibilities to create a healthy and orderly Internet audiovisual program service environment.
2、 All contracting parties shall jointly abide by the national laws, regulations, rules and policies on the construction and management of Internet culture, comply with the provisions of the Regulations on the Administration of Internet Audiovisual Program Services jointly issued by the State Administration of Radio, Film and Television and the Ministry of Information Industry, carry out Internet audio-visual program services according to law, and strictly implement industry self-discipline.
3、 All contracting parties shall actively disseminate Internet audio-visual programs, including films, TV dramas and cartoons, which are healthy and beneficial, conform to socialist ethics, reflect the development of the times and social progress, and carry forward the excellent cultural traditions of the nation, so as to jointly resist the decadent and backward ideology and culture, and not spread violence, pornography, gambling, terror and other harmful to the physical and mental health of minors Internet audio-visual programs that violate social morality and damage the excellent national cultural traditions. The contracting party providing uploading program service shall fulfill the main responsibility of the provider of Internet audio-visual program service, and shall delete the audio-visual programs uploaded by Internet users that contain illegal content, purify the online space, and form a spiritual home for joint construction and sharing.
4、 All contracting parties shall jointly abide by the national laws and regulations on copyright management of online audio-visual program works, actively take copyright protection measures, respect and protect the legitimate rights and interests of copyright owners and Internet audio-visual program service units, create and maintain a fair and orderly copyright environment for online audio-visual programs, and promote the development of Internet audio-visual program service industry.
5、 Each contracting unit shall establish and improve its internal management system, strengthen personnel training, put an end to the spread of bad information, and consciously accept government supervision and public supervision.
6、 Each contracting unit shall establish an industry sharing and mutual aid mechanism for Internet audio-visual program information to maintain effective information communication.
7、 All contracting parties shall jointly establish and improve the "Internet audio-visual program information database" system (net. tv. cn), so that it can provide guidance and services on program information for all contracting parties in a timely manner.
1. The contracting parties are encouraged to recommend the excellent audio-visual programs, including films, TV dramas and cartoons, to other contracting parties through the "information base" system;
2. Encourage contracting units to inform other contracting units of relevant information of audio-visual programs that do not comply with relevant laws, regulations, rules and policies through the "information base" system;
3. Each contracting unit shall log in the "information base" system frequently, delete the above illegal programs and their related links from their websites in time, and consciously implement the self-discipline convention;
4. The information in the "information database" system should only be held by the Internet audio-visual program service practitioners. Each contracting unit has the responsibility of confidentiality and will not disclose it to the outside world.
8、 If a contracting entity fails to perform its contractual obligations under this Convention for a long time or has stopped providing audio-visual program services, it shall be deemed to have withdrawn from this Convention automatically.
9、 Units engaged in Internet audiovisual program services in China that are willing to accept this Self discipline Convention may apply for accession to this Convention.
The initiators of this Convention shall regularly publish the list of units that have acceded to and withdrawn from this Convention.
10、 Each contracting unit agrees to set up an implementing agency for this Convention in due course, and is subject to the supervision and management of the implementing agency.
11、 This Convention shall come into force and be announced to the public after being signed or sealed by the legal representative of the sponsor.
This Convention shall enter into force as of the date of promulgation.
