The hearing of Du Shuanghua, an iron and steel tycoon, resumed in the First Intermediate People's Court of Beijing this morning after more than a year of "cooling down". After hearing, the collegial panel ruled to uphold the first instance ruling of Haidian Court and rejected the appeal request of Du Shuanghua's wife Song Yahong. This case is widely concerned by all sectors of society because it involves the division of property amounting to tens of billions of yuan. However, since the Hengshui Court of Hebei Province had already ruled that Du Shuanghua and his wife were divorced 10 years ago, the content of the first municipal intermediate court hearing this morning was limited to whether the case could be administrated in procedure.

Du Shuanghua is a native of Hengshui, Hebei Province. He started steel manufacturing in 1987 and founded Hebei Jinghua Pipe Manufacturing in 1993. Since 2001, he has successively set up manufacturing and management companies in Tangshan, Baotou, Laiwu, Guangzhou, Sichuan and other places. In 2003, Du Shuanghua and others jointly founded Rizhao Steel Holdings. Rizhao Steel in 2010 pin The sales revenue reached more than 40 billion yuan, and Du Shuanghua is the chairman of Rizhao Steel.
In September 2010, the steel tycoon, worth tens of billions, was involved in a divorce lawsuit. Song Yahong, Du Shuanghua's wife, sued the Shanghai District Court for divorce and division of their common property. During the lawsuit in Haidian Court, Song Yahong claimed that she only knew that she had been "divorced" 10 years ago.
Although Song Yahong claimed that she did not know about the divorce case 10 years ago, nor did she know that Hebei Hengshui Court had judged the divorce of both parties 10 years ago and raised various questions, Haidian Court rejected Song Yahong's lawsuit after hearing it, because Hebei Hengshui Court had judged the divorce of both parties 10 years ago.
"After Song Yahong filed an appeal, because Hengshui, Hebei, had filed a retrial of the divorce case 10 years ago, the First Intermediate People's Court in Beijing ruled to suspend the hearing of the case." Chen Xu, Song Yahong's attorney, told the author that he had not received notice until a few days ago, and the judge asked him to come to the court again this afternoon.
Chen Xu said that the divorce judgment made by Hengshui Intermediate People's Court 10 years ago was wrong and had entered the retrial stage. The execution of the judgment was suspended. The marriage relationship between the two parties was inconclusive. It was wrong for Haidian Court to dismiss Ms. Song's lawsuit according to the judgment of Hengshui Intermediate People's Court.
Chen Xu believed that the Hengshui Court, based on only one visit to the so-called property management personnel, concluded that Song Yahong's whereabouts were unknown, and directly chose the way of public announcement to serve the subpoena and divorce judgment, which was illegal; The announced subpoena for the hearing was also inconsistent with the actual date of the hearing, depriving Ms. Song of her right of action; In addition, there are errors in many aspects such as the name and date of birth in the judgment. Therefore, he requested the First Intermediate Court to order the Haidian Court to continue hearing the case.
Du Shuanghua's lawyer said that the Hengshui Intermediate People's Court only reviewed the property part, and did not involve the dissolution of marriage.
Du Shuanghua and Song Yahong did not appear in court, but entrusted lawyers to answer the lawsuit. The trial of this case in the morning was not open to the media. The judge told the author that this trial was limited to jurisdiction, and the legal fees were only charged 50 yuan, which would not involve tens of billions of property division disputes.
After hearing, the First Intermediate People's Court held that the Hengshui Court had previously judged the two parties to divorce, and the case was still being retried. In this case, Song Yahong asked the Haidian Court to accept and hear the divorce case improperly, so the First Intermediate People's Court made a final ruling to maintain the Haidian Court's ruling of rejecting the lawsuit. It is understood that in the first instance ruling of the Haidian Court, the reason for rejecting the prosecution is that the case "does not meet the acceptance conditions."
