Environmental protection and law

China's Environmental Protection Law, Water Pollution Prevention Law, Air Pollution Prevention Law and other existing environmental protection laws reflect that China attaches great importance to environmental protection. The Criminal Law of the People's Republic of China also has relevant provisions on criminal acts that damage environmental resources:

Pollution type environmental crime: including the crime of environmental pollution, the crime of illegal disposal of imported solid waste, and the crime of unauthorized import of solid waste.

Example: Article 338 of the Criminal Law [Crime of environmental pollution] Whoever, in violation of State regulations, discharges, dumps or treats radioactive waste, waste containing infectious disease pathogens, toxic substances or other harmful substances, thus seriously polluting the environment, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention and shall also, or shall only, be fined; If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years and shall also be fined; Whoever falls under any of the following categories shall be sentenced to fixed-term imprisonment of not less than seven years and shall also be fined:

(1) Discharging, dumping and disposing of radioactive waste, waste containing infectious disease pathogens and toxic substances in key protection areas determined according to law, such as drinking water source protection areas, core protection areas of nature reserves, and the circumstances are especially serious;

(2) Discharging, dumping or treating radioactive waste, waste containing pathogens of infectious diseases or toxic substances into major rivers, lakes and waters designated by the State, and the circumstances are especially serious;

(3) Causing a large number of permanent basic farmland to lose its basic functions or suffer permanent damage;

(4) Causing serious injury, serious disease, or serious disability or death to more than one person.

Crimes against natural resources include illegal mining, destructive mining and illegal felling of trees.

Example: Criminal Law Article 343 Whoever, in violation of the provisions of the Mineral Resources Law, mines without a mining license, enters a mining area planned by the State, a mining area that is of great value to the national economy, or another person's mining area, or mines certain minerals that the State provides for protective mining, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years Criminal detention or public surveillance shall be imposed with or without a fine; If the circumstances are especially serious, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years and shall also be fined.

Environmental crimes endangering ecological balance include crimes of illegal fishing for aquatic products, illegal hunting, etc.

Example: Criminal Law Article 341 [Crime of illegally hunting or killing precious or endangered wildlife] [Crime of illegally purchasing, transporting or selling precious or endangered wildlife, precious or endangered wildlife products] Illegal hunting or killing of precious or endangered wildlife under special state protection, or illegal purchasing, transporting or selling of precious or endangered wildlife under special state protection Whoever endangers wildlife and its products shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention and shall also be fined; If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than 10 years and shall also be fined; If the circumstances are especially serious, he shall be sentenced to fixed-term imprisonment of not less than 10 years and shall also be fined or confiscated of property.

In order to strengthen the fight against ecological environment crimes. The Criminal Law Amendment (XI) further revised and improved the relevant provisions and provisions of the current criminal law on ecological environment crimes, and added the crime of destroying nature reserves:

Whoever, in violation of the laws and regulations on the administration of nature reserves, reclaims or develops land or builds buildings in national parks or national nature reserves, if serious consequences are caused or if there are other serious circumstances, shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention and shall also, or shall only, be fined.

Whoever commits the act mentioned in the preceding paragraph, which also constitutes another crime, shall be convicted and punished in accordance with the provisions on heavier punishment.
