Since 2023, the Longzihu District Procuratorate of Bengbu City has actively implemented the deployment requirements of the digital procuratorial strategy of the highest level procuratorate, guided the practice of legal supervision with the concept of digital procuratorial, strengthened data empowerment, innovated the mode of legal supervision, took big data as the starting point, and built a legal supervision model of "criminal detention downward" through data sharing and collection of public security organs and procuratorial organs, Promote the deep integration of criminal prosecution work and big data.
The case of "criminal detention downward" refers to a criminal case that is filed by the public security organ and the suspect is not transferred to the procuratorial organ for arrest or not transferred to the procuratorial organ for review and prosecution after taking criminal detention coercive measures. Because this type of case has not entered the procuratorial link, there has been a "blind spot" in supervision for a long time.
In June this year, the Longzihu District Procuratorate, together with the public security organ, carried out special supervision on the case of "criminal detention downward". Relying on the Office of Investigation Supervision and Cooperation, 364 pieces of criminal detention personnel data of public security organs in 2022 were retrieved and compared with the data of transferred personnel accepted in the procuratorial business application system of our hospital. It was found that 29 criminal detention personnel of public security organs did not report for arrest or transfer charges. Through consulting the files, analyzing and judging, 22 of them have made the decision to terminate the investigation, transferred to other organs, and sent 6 notices to the public security organs to correct the violation of the law, and supervised the withdrawal of one case.
In order to standardize the criminal investigation activities of the public security organs, the Longzihu District Procuratorate recently discussed with the public security organs to establish a long-term supervision mechanism for "criminal detention downward" cases. Through the application of the "criminal detention downward" legal supervision model, we have broken down the supervision barriers, made big data serve the judicial case handling, and continued to improve the quality, efficiency and effectiveness of digital procuratorial supervision.
