Review of main work in 2023

2023 is the first year to comprehensively implement the spirit of the 20th CPC National Congress. The procuratorial organs of the province adhere to the guidance of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, deeply practice Xi Jinping Thought on the Rule of Law and the concept of overall national security, earnestly implement the spirit of the 20th CPC National Congress and the Second Plenary Session of the 20th CPC Central Committee, deeply understand the decisive significance of the "two establishment", enhance the "four awareness", strengthen the "four self-confidence", and achieve the "two maintenance". Under the strong leadership of the Supreme People's Procuratorate and the Provincial Party Committee, under the strong supervision of the Provincial People's Congress and its Standing Committee, with the care and support of the provincial government, the provincial CPPCC and all sectors of society, we have faithfully, dutifully, courageously, and fully escorted the construction of a modern and beautiful Anhui, and achieved new results in all our work.

In the past year, 239000 cases of all kinds were accepted, up 25.1% year on year. Among them, 117000 supervision cases were handled, up 60% year on year. A total of 48 cases were selected as typical cases of national procuratorial organs, 37 collectives and 21 individuals were commended at or above the provincial and ministerial level, 2 prosecutors were awarded the title of "National Model Procurator" by the highest procuratorate, 3 collectives and 5 individuals were awarded the first class merit by the highest procuratorate, 13 jobs were approved by the highest procuratorate and provincial party committee leaders, and 18 work experiences were recommended by the highest procuratorate. The Provincial Procuratorate has been rated as the provincial excellent unit for safety construction for 14 consecutive years, and the provincial excellent unit for the assessment of the responsibility objectives of the petition work for 9 consecutive years.

1、 Continuously improve the quality and efficiency of political construction and inspection to ensure the correct direction of procuratorial work

We will carry out in-depth education on the theme of Xi Jinping's socialism with Chinese characteristics for a new era. The theory study runs through the whole process, leading prosecutors to learn, think and use, and unify knowledge, faith and practice. Daxing carried out investigation and research around 17 key topics and promoted the effective solution of 64 problems. Integrated rectification and improvement, 189 solutions were studied and formulated around 8 problems, forming 27 typical cases.

We will resolutely implement the decisions and arrangements of the CPC Central Committee and the work requirements of higher authorities. We will establish working mechanisms such as the "reverse connection" of execution and the consultation between judicial and procuratorial organs to enhance the synergy of work. Strictly implement the Regulations on the Political and Legal Work of the Communist Party of China, and take the initiative to ask for instructions and report 19 major issues to the provincial party committee and the political and legal committee of the provincial party committee. Implement the requirements for political supervision within the Party, actively cooperate with the inspection team of the Supreme People's Procuratorate, strengthen the rectification of problems, and have established six aspects of reform.

Promote the connection between various types of supervision and legal supervision. We deepened the connection between law enforcement supervision and legal supervision by the Political and Legal Affairs Commission of the Party Committee, and handled 573 cases assigned by the Political and Legal Affairs Commission of the Party Committee. We established a mechanism to link the democratic supervision and legal supervision of the CPPCC, transformed the proposals of CPPCC members into 696 cases of public interest litigation, and transformed the clues of public interest litigation into 42 proposals of CPPCC members. A benign interaction mechanism was established to link public opinion supervision and legal supervision. The procuratorial organs obtained 85 clues from public opinion channels, and 67 cases were filed.

2、 Continuously improve the overall quality and efficiency of services, and escort high-quality development of Anhui according to law

We will resolutely safeguard national security and social stability. 23789 suspects were arrested and 78760 were prosecuted. Implement the overall national security concept and crack down on crimes against national security. Normalized anti mafia and elimination of evil, 1484 people were prosecuted for crimes involving mafia and evil, and 14 people were directly put on file to investigate the "umbrella". Serious violent crimes were severely and quickly punished, and 2474 people were prosecuted for intentional homicide, robbery and other crimes. Maintaining a high pressure on public related crimes, 4041 people were prosecuted for telecommunications network fraud, illegal fund-raising and other crimes in accordance with the law.

Help to create a first-class legal business environment. Actively participated in the special action of "Political and Legal Escort" and "Judicial Protection of Private Enterprises", and prosecuted 6451 people for crimes against market economic order. We deepened the compliance reform of enterprises involved in cases, created a "weekend consultation" mechanism for enterprise cases, and handled 151 compliance cases. We deepened the work of "entrepreneurs meeting with the chief procurator". The chief procurator of the tertiary court received 1539 entrepreneurs and helped solve 745 problems.

Actively serve the implementation of major strategies. Focusing on the rural revitalization strategy, special actions were carried out, 789 people were prosecuted for crimes against "agriculture, rural areas and farmers", and 3380 public interest litigation cases were handled. Focusing on the innovation driven development strategy, 1530 people were prosecuted for IPR infringement crimes, and 50 public interest litigation cases involving IPR were handled. Focusing on the integrated development strategy of the Yangtze River Delta, judicial cooperation has expanded to new areas such as social governance and cultural heritage protection. Focusing on the green development strategy, 2196 people were prosecuted for crimes against environment and resources, and 4797 public interest litigation cases were handled for ecological environment and resource protection.

Boost the modernization of social governance system and governance capacity. Jointly carried out supervision and supervision work with the provincial government to promote the implementation of public policies and the implementation of government commitments, formulated and issued 73 procuratorial recommendations in accordance with the law, and urged the implementation of more than 120 million yuan. We will promote the development of a misdemeanor governance system, and apply the system of relatively non prosecution and leniency of punishment when pleading guilty to a crime according to law for crimes with minor subjective malignancy, first offence and minor circumstances. Focusing on the problems such as the unsound supervision system of elderly care institutions and the non-standard operation of e-commerce platforms, 2413 pieces of social governance inspection recommendations were issued to the competent authorities, up 45.3% year on year.

3、 Continuously improve the quality and efficiency of justice for the people, and pragmatically improve people's well-being

We will spare no effort to protect the safety of the masses. Deeply participated in the three-year action of "curbing contraband, controlling residues and promoting improvement", prosecuted 1230 people for crimes against food and drug safety, and handled 1984 public interest litigation cases. We resolutely guarded production safety, prosecuted 205 people for crimes against production safety, and handled 1027 public interest litigation cases. We will resolutely safeguard the security of citizens' personal information, intensify efforts to crack down and punish, and prosecute 335 people for crimes such as the disclosure and trafficking of personal information.

Focus on responding to the judicial concerns of the masses. Deepen the procuratorial supervision of the "5+N" activities to protect people's livelihood and interests, and use the rule of law to solve the difficulties and anxieties around the masses. The "procuratorial blue" campaign was launched to help eradicate the wage arrears of migrant workers, prosecuted 120 people for crimes of refusing to pay labor remuneration, and supported 4344 cases of migrant workers' wage claims. Deepen the bright side construction of "popular echo and warmth control", receiving letters and visits from the masses decreased by 7.8% year on year, and the resolution rate of repeated letters and visits and the satisfaction of the masses both ranked top in the country.

We will strengthen the protection of the rights and interests of special groups. We strengthened the comprehensive performance of minors' procuratorial work, put forward 80 suggestions on prohibition of employment and sentencing, and urged 136287 people to carry out on-the-job inquiries; 2842 people have prosecuted crimes against minors, and 1360 people have not prosecuted minors with conditions. We strengthened the protection of the rights and interests of women and the elderly, deepened the special supervision of "half the sky" and "sunset red", prosecuted 2474 crimes against the rights and interests of the elderly and 23 domestic violence crimes. We strengthened the protection of the rights and interests of military families, prosecuted 10 people for crimes such as sabotaging military marriages, and carried out 53 military related judicial assistance.

4、 Continuously improve the quality and efficiency of legal supervision and resolutely safeguard fairness and justice

Deepen criminal procuratorial supervision. Strengthening investigation supervision and cooperation with the Office of substantive and standardized operation, supervising 3153 cases filed and 3160 cases withdrawn; 4922 cases of missing catch and complaint were corrected; 7639 cases of illegal investigation activities were corrected in writing. We strengthened supervision over criminal trials, corrected 1803 violations of criminal trial activities in writing, and the adoption rate was 100%; 433 protests were filed against criminal decisions that were believed to be wrong, with the adoption rate of 87.4%. We strengthened the supervision of criminal execution activities, promoted the pilot tour inspection of community correction institutions, and supervised in writing the correction of 3130 people who were improperly sentenced to commutation, parole, and temporary execution outside prison.

We will strengthen civil procuratorial supervision. The "Year of Tackling Difficulties" of civil procuratorial supervision quality and efficiency was carried out, and 14533 cases were accepted, up 35.5% year on year. Among them, 310 protested, with a court retrial change rate of 91.4%; 533 retrial procuratorial suggestions were put forward, with the adoption rate of 90.1%. We carried out special supervision on fake judicial confirmation, arbitration notarization and civil adjudication for in-depth violations, and supervised and corrected 303 false lawsuits. We strengthened supervision over civil enforcement activities, put forward 2729 written prosecutorial suggestions to correct violations of enforcement activities, and prosecuted 153 people who refused to execute judgments and were convicted of crimes.

We will strengthen administrative procuratorial supervision. A separate administrative procuratorial department was set up in the provincial procuratorate, and 3136 administrative supervision cases were handled in the province. We explored and carried out supervision over administrative violations, and handled 1727 cases of supervision against the illegal exercise or non exercise of authority by administrative organs. Normalize the substantive resolution of administrative disputes, strengthen the organic connection between administrative procuratorial work and administrative mediation, administrative reconsideration, and administrative adjudication, and resolve 150 administrative disputes.

Improve the accuracy and standardization of public interest litigation. 11447 public interest litigation cases were handled, up 31.6% year on year. Among them, 1901 public interest lawsuits were filed, up 37.5% year on year. We strengthened the protection of public interests in the four statutory areas, urged the restoration of 491.7 hectares of forest land, cultivated land, wetlands and lakes, and urged the protection and recovery of state-owned property and rights worth 80.653 million yuan. We will steadily expand other areas of case handling, and carry out special supervision on public interest litigation in areas such as ancient village protection and barrier free environment construction.

Actively participate in the fight against corruption. After reviewing and prosecuting 853 cases of duty crimes, 684 people were decided to be prosecuted. Adhere to the joint investigation of bribery, issue the "Eight One" Work Measures to Punish Bribery Crimes, and prosecute 101 bribery crimes. Steadily promote procuratorial and investigative work, promote provincial and municipal procuratorates to establish procuratorial and investigative departments, activate the "power of mobile investigation", file and investigate 65 judicial staff related duty crimes, and file and handle 4 "mobile investigation" cases.

5、 Continuously improve the quality and efficiency of reform and innovation, and enable the modernization of procuratorial work

We will promote the construction of a mechanism for handling cases with high quality and efficiency. The main evaluation indicators of the quality of nine cases rank among the top in the country, and 14 indicators are better than the national notification value. We promoted the separation of complex and simple cases, and the separation of speed and speed, and the length of first instance public prosecution cases in the province decreased by 24.6% year on year; The application rate of the criminal case quick determination procedure was 36.5%, up 3.5 percentage points. Strengthen case guidance, and carry out the selection of typical cases and high-quality cases regularly.

Promote the construction of the procuratorial performance system. The provincial and municipal procuratorial work modernization research centers were first established in the procuratorial organs of the country, and 22 research results were formed. Strengthen vertical linkage, explore the establishment of follow-up supervision and follow-up supervision mechanism, and enhance the joint force of procuratorial work from top to bottom. Strengthen horizontal cooperation, establish and improve the internal transfer mechanism of legal supervision clues.

We will deepen the implementation of the digital procuratorial strategy. We strengthened data integration, promoted the construction of "six centers" for digital procuratorial work, and collected and sorted out more than 80 million pieces of data. We strengthened technical support, designed and launched 395 legal supervision models. We carried out the special action of big data legal supervision, handled 4368 supervision cases, and directly recovered more than 34.9 million yuan of losses for the country. The procuratorial organ of Huaibei City quickly developed a supervision model based on the clues of fake and inferior fire extinguishers found in the case handling. Through big data analysis, it found and transferred 348 relevant case clues, involving 27 provinces across the country. The model won the first prize in the big data legal supervision model competition of the national procuratorial organ.

6、 Continuously improve the quality and efficiency of self construction and consolidate the high-quality development foundation of procuratorial work

Comprehensively improve the team's ability to perform their duties. Adhering to the principle of personnel inspection, one procurator was awarded the title of national procuratorial expert, seven procurators were awarded the title of national procuratorial "pacesetter" and "expert", and one procuratorial police was awarded the title of "Top Ten Public Prosecutors" with the first place. In the same class training, 445 people were trained in the same class with the Provincial High Court, the Provincial Public Security Department, the Provincial Department of Justice and other units. We will improve the system of expert advisory committees, and comprehensively promote the work of professionals in administrative organs concurrently serving as assistant prosecutors.

We will steadily promote infrastructure development at the grass-roots level. Cooperate with the Party Committee to select and strengthen 110 leading group members of the municipal and county procuratorates. Deepening the "brand and model" double leading and striving activity, Wangjiang County Procuratorate was rated as the national model procuratorate, Bengbu Bengshan District Procuratorate and the sixth procuratorate department of Chizhou Procuratorate were awarded the first class collective merit of the highest procuratorate honor, and Suzhou Procuratorate's case of "refined and heart shaping inspection" was rated as the second batch of "top ten cases" of the deep integration of party building and business of the national procuratorate.

Thoroughly promote comprehensive and strict inspection. Strictly implement the system of consultation with the discipline inspection and supervision team stationed in the People's Procuratorate, and carry out political inspection on the White Lake Procuratorate and the Jiuchengban Procuratorate. We carried out a thematic discussion on "Six Breaks and Six Lifts" and issued the Self discipline Proposal for Policemen Eight Hours Away to all prosecutors. The construction of the mechanism of "three non corruption" and "black under the lamp" was promoted in an integrated way, and 10554 major issues such as "three regulations" were filled in, with a year-on-year increase of 55%. Regularly carried out the warning education of "taking cases as a lesson and striving to improve the style of work", and the discipline inspection and supervision organ filed a case to investigate and review 33 procurators who violated disciplines and laws, a year-on-year decrease of 13.2%.

Over the past year, we have conscientiously implemented the resolution of the first session of the 14th Provincial People's Congress, and formulated a list of 20 proposals proposed by the deputies, which has been completed and replied. Special report to the Standing Committee of the Provincial People's Congress on the work of procuratorial recommendations, and cooperate with the Standing Committee of the Provincial People's Congress to take the lead in introducing the Resolution on Further Strengthening the Work of Procuratorial Recommendations nationwide. Actively reported the procuratorial work to the CPPCC Provincial Committee, completed and replied to 12 proposals made by CPPCC members. Representatives of the Provincial People's Congress and members of the CPPCC were invited to carry out cross inspections of procuratorial work and listen to opinions and suggestions. The provincial procuratorate held 12 press conferences to promote the sunshine procuratorial work, and opened more than 110000 pieces of procuratorial information. The openness and transparency of procuratorial work have been among the top procuratorial organs in China for many years in a row.
