Defendant Wei Moumou, male, born on * * * *, 1975, ID card number 3402041975 ****************, Han nationality, technical secondary school culture, employee of Wuhu * * Auto Products Co., Ltd., whose domicile is 107, No. 10, * * Road * *, Jinghu District, Wuhu City, Anhui Province, now lives in * * Unit * *, * * Building * *, Jinghu District, Wuhu City. The defendant, Wei Moumou, was sentenced to 11 years' imprisonment by Wuhu Xinwu District Court in September 2000 for the crime of rape and provocation. On June 26, 2019, the defendant Wei Moumou was released on bail by the Jinghu Branch of Wuhu Public Security Bureau on suspicion of dangerous driving.

The case was investigated and concluded by the Jinghu Branch of Wuhu Public Security Bureau. The defendant, Wei, was suspected of dangerous driving and was transferred to our court for review and prosecution on August 1, 2019. After accepting the case, the court informed the defendant within three days that he had the right to entrust defenders and the possible legal consequences of pleading guilty and accepting punishment, interrogated the defendant according to law, and reviewed all case materials.

After legal review, it is found that:

At about 17:55 on June 14, 2019, when the defendant, Wei Moumou, was drunk and driving a small car with the license plate of Wan *******, from south to north along Changjiang Middle Road in Jinghu District of our city to Wangjiaxiang Flyover, he ran into the normal driving license plate of Wan ******** in front of him, which was hit hard afterwards, As a result, the Wan ******** small car collided with the front one with the number plate of Wan ********, that is, the traffic accident in which three cars collided. The defendant, Wei, is fully responsible for this accident. After that, the police on duty arrived at the scene and found Wei who was suspected of drunk driving. According to the identification of the Judicial Identification Institute of Anhui Normal University, the defendant, Wei, has a blood alcohol content of 115.2mg/100ml and is drunk driving a motor vehicle.

The evidence for ascertaining the above facts is as follows:

The Court believes that the defendant, Wei Moumou, who drove a motor vehicle while drunk, has violated the provisions of Paragraph 2, Paragraph 1, Article 133-1 of the Criminal Law of the People's Republic of China. The criminal facts are clear and the evidence is really sufficient, so he should be investigated for criminal responsibility as a dangerous driving crime. The defendant, Wei Moumou, who was able to truthfully state the facts of the crime after arriving at the case, is frank and should be punished according to the provisions of Paragraph 3 of Article 67 of the Criminal Law of the People's Republic of China. In order to maintain the normal order of transportation and the inviolability of public safety, the Court initiated a public prosecution in accordance with the provisions of the first paragraph of Article 176 of the Criminal Procedure Law of the People's Republic of China, and please be sentenced according to law.
