Maanshan Yushan: "support prosecution+judicial assistance" to protect the legitimate rights and interests of the elderly

   "Prosecutor, after my son died of illness, my daughter-in-law and grandson and I have been unable to negotiate because of the legacy he left behind. Now we are both over 80 years old and have a difficult life, so they must give us some money!" In June 2022, the People's Procuratorate of Yushan District, Ma'anshan City received help from two elderly people.  

   Two old people, Zhang Moujia and Xiang Mouyi, are the parents of the deceased Zhang Mouyi. On December 12, 2019, Zhang Mou B died of illness and left a legacy. Zhang Mou A filed a lawsuit to the court for inheritance disputes with his daughter-in-law and grandchild, asking for the division of the estate. However, because the prosecution materials provided by the two elderly people could not preliminarily prove the ownership of the property required to be divided, and did not meet the conditions for accepting the case, the court finally ruled that the case should not be accepted.  

   Then came the scene of asking for help at the beginning. After receiving the application of the two old people, the People's Procuratorate of Yushan District, considering the mobility of the old people, rushed to the temporary residence of the two old people in the high temperature to inquire about the specific situation of the case and the difficulties they faced. Zhang Moujia told the case handlers that they had negotiated with their daughter-in-law and grandchild for many times to divide the inheritance left by their son, but none of them succeeded. They did not know the law themselves, and their ability to collect evidence was limited. They hoped that the procuratorial organ could help them safeguard their legitimate rights and interests through the law.  

   After examination, the court considered that Zhang and Xiang were old, weak and ill, and their activities were limited. Their own strength was not enough to safeguard their legitimate rights and interests, and they met the conditions for the procuratorial organ to support the prosecution, so it decided to support the prosecution of the inheritance dispute case. Considering that Zhang and Xiang are both over 80 years old and suffer from a variety of chronic diseases, they spend a lot of money on hospitalization and drug purchase every year, making life difficult. While supporting the prosecution, the court decided to start the judicial relief procedure and send the judicial relief funds in time, which eased the economic urgency of the two elderly people.  

   On July 5, 2022, the People's Procuratorate of Yushan District served the Opinion of Support for Prosecution and the evidence materials obtained to the filing department of the people's court at the same level. The court will file the case of inheritance dispute after review and hold a court hearing at a selected time. The court will continue to pay attention to the trial results of the case and provide support and assistance in a timely manner.  

   It is the bounden duty of justice to care for the elderly and make them feel the warmth of justice. In the judicial process, this may be just an ordinary small case, but it is "a big thing" for the people and the parties. When the elderly are unable to independently protect their legitimate rights and interests and need the support of relevant organizations, the People's Procuratorate of Yushan District gives full play to its function of supporting the prosecution, helping the vulnerable groups to realize their litigation rights. With the spirit of "I am in litigation", the People's Procuratorate diligently and passionately handles small cases around the masses, demonstrating the procuratorial responsibility of justice for the people.
